Police arrested a man for beating to death an ex-con who broke into his Morrisania apartment building, hit his wife and stripped off her clothes Monday night, police said.
Earl D. Nash, 43, broke into 1240 Washington Ave., near East 168th Street, about 9:26 p.m. and hit a 51-year-old woman across the head before taking off her clothes, an NYPD spokesman said.
The woman managed to break free and call her husband, Mamadou Diallo, 61, who was just outside the building and came to her aid, police said.
Diallo found Nash in a sixth-floor hallway and began beating him, police said.
Nash was pronounced dead at the hospital, police said....
Diallo and his wife have a 16-year-old son, according to a family friend.
"He's a good guy. He's been in this country 27 years and never had a problem," the friend, who asked not to be named, said of Diallo.
Nash has been arrested 14 times since 1997, according to an NYPD spokesman.

He was charged with 2nd degree murder. I guess they figured he should have stopped at some point.
Well, that is New York for you. If the would be rapists had killed the man and then went on to rape and kill the wife...everything would have been good. Now, this man has learned the hard way that in New York City, the criminal is protected.

This case is a perfect candidate for jury nullification.
Most people don’t know about the concept of jury nullification so, if you have friends that actually answer jury summons, tell them about it.
I have to admit that I have never served on a jury because I have never been dumb enough to respond jury summons delivered by regular mail. I do so becaus any jury summons that is not “served” directly to you by an agent/officer of the court is not a legally binding instrument. This is true of photo radar tickets. If they don’t play by the law why should I play by the “rules” they make up that save them money and effort that trick citizens into compliance.
From initial investigation and facts, it appears Mamadou Diallo was arrested for taking out the trash.
Just doing the work American judges won't do. Hope this one goes free.
After a man hits your wife with his fists and a chair, promises to rape her, and rips her clothes off, you’re supposed to stop beating on him? Who knew? It will take an amazing prosecutor to convince a jury of that idea.
rapists, armed robbers, drug dealers and petty criminals and major are always useful to a totalitarian state. They keep the middle class off balance and help prevent opposition from forming. The USSR used them so.
In England now, self defense is a crime. Killing in self defense is a much more serious crime than whatever the killed criminal might have been attempting. The Left is trying to bring that to the USA and if they win in November they will, probably during 2017.
