A Lexington woman is sentenced to 20 years in prison after a 15-year-old boy dies of alcohol poisoning at a party at her home.
15-year-old Nicholas Faught died at the party allegedly hosted by Tonya Moss and Justin Moore in March of 2015.
At the sentencing, the victim's mother gave her testimony, the whole time choking back tears and looking straight at Moss saying she will never understand what her family is going through.
The defendant also gave her testimony, claiming she did not know about the party and thought her son was only having a bonfire with a few friends.
She claims she was not home at the time.
She said she was at a casino which prosecutors said was a violation of her probation for previous drug charges.
The defendant claims when she got home, she found Nicholas dead on the bathroom floor and she then left the home because she was scared of what might happen to her.
During cross-examination, she admitted to knowing her son has had alcohol with his friends at her home in the past and she would rather it be there than out.
Defense attorneys asked for a suspended sentence, but the judge told the defendant she believes this was a fair sentence for the crime committed.
Family members of the victim said they are satisfied with the sentence.
"She should have as much time as possible to just sit and think about what she did and what she's caused our whole family to go through. Not even our whole family, the whole town, for that matter," said Kali Faught, the victim's sister.
Faught's family members said they believe Justin Moore, Moss's boyfriend who was with her that night, is expected in court sometime in October.
Moore is also charged with accessory after the fact in a Pottawatomie County murder.

But in Europe you can stab somebody to death and get out in seven years. It is becoming that way in more of our states too.
My wife has bought into this idea that you should let your kids drink in your home so they won’t do it elsewhere and drive. I guess it’s a permissive mothering thing but I say no way. If we decided to let our kid drink, well, I’m not for that but at least it’s our decision. I will never provide alcohol to other people’s kids nor allow it to happen in my home. Period.
I could understand this if she went out and bought the booze and set it out for the kids. But doesn’t that raise a conspiracy in that Jr. and the rest of the kids might have been involved in the arranging and invitation to the party? If so, how much time did Jr. get for arranging the party where this happened?
Otherwise, if in fact she was not present, did not buy the booze and Jr. broke into the liquor cabinet then 3-5 years tops.
20 years in jail for 15 year olds at your house drinking? She didn’t even give them the alcohol.
In a nation where illegal alien criminals are released into society or where GITMO prisoners are paroled with “house arrest” in Uruguay - does this sentence not seem a bit excessive??

A modest and supervised measure of beer or wine in an appropriate setting on a special occasion? Or DRANK’N? One is introduction to social civilities, if observed in that household and agreed upon. The other is a damned bad idea.

Agreed! Very foolish and presumptuous to do otherwise.
Well, check it out for yourself, but I think research actually showed that what your wife suggests, doesn’t result in kids who are more responsible drinkers.

Certainly not mother-of-the-year material.
We have always allowed our children to drink wine when we serve it with meals at home which is about 4-6 times a year. Now all young adults, none have shown any proclivity towards a party lifestyle. Two are tea totallers because they just don’t like the taste of any alcohol beverages.
If you expect children to learn to drink responsibly, you teach them, they certainly won’t learn it from their peers.
Sad but true...
It’s an idea that sounds somewhat logical in its way, but the liabilities (as this case shows) are astronomical.
This is a great example of something that maybe “should” be OK, but if it goes wrong and the law decides to come down on you in the form of a zealous prosecutor....you’ll seriously regret it. This is an example of the law-centric difference between adults and minor children. Legally, minors are responsible for nothing, and the peculiar way the law convolutes around this, in this kind of event, the adult is held responsible x 3. For example...this woman, if she killed a kid while driving drunk, would probably not get a 20 year sentence. 8-10-12, maybe.
And your H/O insurance, if you allow or hint that you allow minors to drink in your home, will cover none of it.
I went to the source and didn’t find any more information than what was cut and pasted. I strongly suspect there was more evidence presented than what appears in the TV station’s website. I’m also guessing that a good part of the justification for this was her claim that she found the kid dead in the bathroom and left him.
She’s not a doctor. How did she know he was dead? Maybe he wasn’t.
And Jr. sounds like he is going down that same path. He and his friends are probably still laughing about it!
We hosted graduation parties for both of our boys. While as many adults as kids attended, we did not make any alcohol available at all even to adults. While we believe that most of the kids we knew were good kids, we didn’t know every kid that came and went. So by not having any alcohol, nobody could claim they got it at our house if things went wrong later.
Trust but verify.
Arm chair quarterbacking is tough, but at some point if they are going to make sure all these kids have some right to be whatever that want at any given moment or whim, they need to be held accountable.
We had a case here where something similar happened and the Dad got 3 years but he was a small business man and didn’t have this ladies background.
That’s right. Better for kids to drink and die in the streets, alleyways and woods.
Even if you make a death penalty for giving booze to kids, they’ll just make their own. Teens LOVE booze and would drink hand sanitizer to get drunk.
When I used to teach, I knew kids that would make mead that exceeded 20% with stuff sold at any supermarket. Takes only a few hours of mixing after school before the parents get home. One month sitting in the back of a closet and you can make gallons of really good booze...
