BREAKING: Federal Judge Strikes Down DC Concealed Carry Law, 'Good Reason' Provision Likely Unconstitutional

The fight over Second Amendment rights in the nation’s capital has entered a new phase. A federal judge has ruled that the city’s concealed carry law is likely unconstitutional, citing the “good reason provision” in the injunction order on Tuesday (via WaPo ):

For the second time in as many years, a federal judge in Washington ordered the city to halt enforcement of its new, concealed-carry law, requiring applicants to state “good reason” to carry a weapon in order to obtain a permit from police.

The preliminary injunction was contained in a 46-page ruling Tuesday by U.S. District Judge Richard J. Leon that will be in force pending further litigation. Leon declared the District’s gun-permitting system is likely unconstitutional. The system was adapted by the District after its long-standing ban on carrying firearms in public was overturned at court order in 2014.

If the judge ordered members of the DC City Council to be arrested for contempt they would soon change their view.

this is where they plaintiff demands the city be FORCE to submit any regulation for court approval PRIOR to enactment. (ala the voting rights act) or face crippling fines and legal fees. AND contempt of court for the individual officials and bureaucrats

Sigh....if only this could happen here in New Jersey...

When you have money to burn, you file a lawsuit using this as precedent.

Paging Michael Bloomberg.. Paging Andrew Cuomo.. Up yours....

Do we know if common sense is coming to New York or are we to live with the "safe" act?

They were probably hoping by the time the challenges worked their way thru the courts, there would be a couple new Obama appointees to flip the scales.

Did the judge hold the SOBs in contempt for their absurd obfuscation and denial of the previous order upholding the Second Amendment? Regrettably, I see no sign of it and that is why the Fascists keep conniving and coming back over and over again and again with different ways to undermine the right. Until these mentally ill twisted bastards are held personally accountable, punitively and financially, these games will continue.

You may want to read the article closer. The judge struck down DC’s unconstitutional provision that a good and substantial reason is necessary for the state to authorize a CCW.

Several states include this nonsense. In the case of Maryland, I think only one person determines if your reason is good enough. Self-protection is NEVER a reason.

Yep, my good reason is: “Because the government doesn’t want me to have one.”

Any kind of gun permit is gun registration. IMO.

All the more reason for the House of Representatives to review each and every line in the D.C. budget as they are Constitutionally empowered to do.

And then I did...as noted in replies 20 and 26.

Sorry, you were backtracking while I was typing.

I had to read it twice too. Typical journalist. Why be clear when you can be obtuse and longer.

You would think these idiots in the DC City Council would get it by now

The Congress shall have power...To exercise exclusive legislation in all cases whatsoever, over such District (not exceeding ten miles square) as may, by cession of particular states, and the acceptance of Congress, become the seat of the government of the United States.

It's Congress that needs to "get it", not the pretend City Council.

New Jersey is a sovereign state with police power proper to a state, extensive in scope.

DC is neither. DC's gun laws should be written by Congress.

This is the Congress's fault. DC is not capable of home rule. Look at the crack head whore monger they elected over and over as Mayor and then councilman, the late Marion Barry.

Congress has total jurisdiction over DC (not even clear the POTUS has to approve their running it).

The GOP should write the best-in-the-nation gun law for DC, and tell them: The city council may not legislate in the area anymore.

But the GOP Congress are spineless, balless clowns and half of them will probably secretly vote for Hillary.
