Republicans have assumed this entire elections season that a candidate must have won at least 8 state primaries or caucuses to be eligible for the GOP nomination, but apparently that is not the case and apparently a rule change hasnt technically occurred, but thats not the way it seems.
Even Ted Cruz said just last night that John Kasich wasnt eligible because he hadnt won enough states, so even he was mislead.
Insiders now say rule 40(b) only applied to the republican convention in 2012 and was never intended to be used in future elections.

Party officials and knowledgeable sources have confirmed over the past few days that Rule 40(b) doesnt exist for the purposes of the upcoming convention. That means at this point, the three candidates left in the race, front-runner Donald Trump, Sen. Ted Cruz of Texas, and Ohio Gov. John Kasich, are all eligible for the nomination, as, possibly, are the Republican contenders who have since suspended their campaigns.
Ben Ginsberg, a Republican elections lawyer who was involved in rule-making process for the 2012 convention, said that Rule 40(b) isnt transferrable to the 2016 convention. Ginsberg explained to the Washington Examiner that what was passed in 2012 applied only to 2012, and that the 2016 convention must pass its own rule determining nomination eligibilty.
RNC Chairman Reince Priebus confirmed Ginsbergs assessment on Sunday during a television interview. There will always be a perception problem if people continue to miss to not explain the process properly. So, the 2012 rules committee writes the rules for the 2012 convention. The 2016 rules committee writes the rules for the 2016 convention, he told CNN.

So the Committee could come out with a new rule that states candidates who win a majority of delegates in more than 5 states are INELIGIBLE (in the cause of White Privilege no doubt) and we should be fine with that?

Maybe they’ll make a rule that only candidates who have previously held some national elected office are eligible for the party nomination ? That would exclude Trump and put Cruz, Kasich, Rubio, and Jeb back in play.
The RNC keeps reminding everyone that the PARTY has the right to nominate whoever they like, which makes the Primary process inclusion of voters a farce. If that was going to be the case, the voters deserved to know from the beginning. Trump would have run 3rd Party and the GOP would have Jeb and Cruz and Kasich fighting it out and still losing in national polls to Trump running as an independent.
Way back at the beginning, Trump extracted a promise from the RNC to “treat him fairly” in exchange for his promise no to run 3rd Party. If the RNC throws away its honor, the GP is FINISHED.
If that happens, Trump should demand immediate action from all the State election boards to allow late filing for Independents and get his name on all ballots. GOP voters will vote for him just out of spite for what the RNC has done. The GOPe candidate will have the distinction of the lowest vote count in history.
The two party system is hardwired. Restrictive ballot access rules reinforce the uniparty hegemony. You didn’t think theyd let us peasants have a competing political party, did you?

It won’t matter if he has more than 1237 delegate if they write a new “rule” that only candidates who have previously held national elective office are eligible.
