The Right to Sue the Gun Industry

The world recoiled in horror in 2012 when 20 Connecticut schoolchildren and six adults were killed at Sandy Hook Elementary School by a deranged teenager using a military-style assault rifle to fire 154 rounds in less than five minutes. The weapon was a Bushmaster AR-15 semiautomatic rifle adapted from its original role as a battlefield weapon. The AR-15, which is designed to inflict maximum casualties with rapid bursts, should never have been available for purchase by civilians.

This is the eminently reasonable point that the parents of the 6- and 7-year-old students cut down at the school are now pressing in Connecticut state court. They are attempting to sue the gun manufacturer, Remington; the wholesaler; and a local retailer for recklessness in providing the weapon to the consumer marketplace “with no conceivable use for it other than the mass killing of other human beings.”

The question of whether the lawsuit will be allowed to proceed is at issue because Congress, prodded by the gun lobby, in 2005 foolishly granted the gun industry nearly complete immunity from legal claims and damages from the criminal use of guns.

The Sandy Hook parents argue that their suit should continue because that law, the Protection of Lawful Commerce in Arms Act, allows claims against companies — gun shop dealers, for example — if they knew or should have known that the weapons they sold were likely to risk injury to others. The parents contend that the maker of the Bushmaster is no less culpable because it knowingly marketed a risky war weapon to civilians.

Recently, near my town, a guy got off work, got drunk, entered the freeway on the wrong side, crashed his car into a minivan and killed a family of four.

Who/what is most responsible? The driver? The place that served him the alcohol to get drunk? The highway department for not building a barricade that prevents drivers from getting on the wrong side of the freeway? The folks who built the actual killing machine - the automobile?

If you chose the latter, you could be a Democrat.

Knives are war weapons,
Bows and arrows are war weapons,
.38 revolver are war weapons,
blackpowder rifles are / were war weapons.

Where does it end - ultimately with only the military and the police owning weapons. Just like in Shindler’s list.

Whatever.

The reality is that Trump used to back an assault weapons ban, and with his flipflopping and deal making could do so again.

It really makes little difference to me personally, because I will own what I own as long as I breathe. FMCDH.

I respect it, but I’m also saying that HE CANNOT BE THE CANDIDATE in November. The best he can do now is deny Trump and outright win, thereby letting the GOPe choose our candidate, which GUARANTEES a DEMOCRAT WIN in November.

I know a guy who has several ARs. Oddly enough, for owning weapons whose sole use is killing people, he's never used them to kill people! I don't know what else he can do with them, but it seems like he's got a lot of money tied up in things he doesn't even use for their only intended purpose.

Or it could be that this is nothing more than the same tired anti-gun rhetoric the Times has been spouting for that last half a century -- ill-informed, hyperbolic, and patronizing. And just another day in the life of an East Coast crap machine.

Yes, the NY Slimes are nuts.

They want to win with lawsuits what they cannot legislatively or Constitutionally.

The legal theory is insane. If ever there were a valid militia weapon, it is the AR-15, which is used in far less homicides in a year than hands and feet or clubs or knives.

Handguns are used about 20 times as often.

Hard to believe they are this insane, but they are.

At least two people were injured in a shooting outside the Foot Locker in Brooklyn Center, Minn. Saturday morning. Brooklyn Center police believe the shooting was over a pair of the newly-released Michael Jordan shoes.

Demonstrating the unbounded ignorance of the NYT. My Bushmaster has NEVER done a ‘rapid burst’...never. It’s a semiautomatic, idiots.

And, then to their notion of who should be able to buy it...what part of ‘shall not be infringed’ don’t you understand, NYT?

The pain those families feel is very real, and very deep. Of that, I have not doubt. But, that is not sufficient to suspend logic and reason.

Too funny! NYT writers haven’t clue one about firearms. The AR-15 fires bursts???? Bursts can only come from a selective fire weapon, or a fully automatic machine gun.

Moreover, the M-16 was based on the AR-15, not the other way around.
