ew York appeals court denied Fox News host Bill OReillys petition seeking custody of his two children, Gawker reported on Monday.
The courts Feb. 24 ruling upheld a Nassau County Supreme Court decision granting full custody of the 12-year-old boy and 17-year-old girl to Maureen McPhilmy, the Factor hosts ex-wife.
Viewing the totality of the circumstances, there is a sound and substantial basis for the Supreme Courts determination that it is in the best interests of the children for the mother to be awarded primary residential custody, the Appellate Division Second Judicial Department court stated. Particularly relevant in this case are the clearly stated preferences of the children, especially considering their age and maturity, and the quality of the home environment provided by the mother.
Court transcripts published last May showed that the girl told a court-appointed psychologist that OReilly was choking her mom or had his hands around her neck and dragged her down some stairs.
The psychologist, Larry Cohen, also testified that the daughter told him that OReilly described McPhilmy as an adulturer, and described McPhilmys new husband as not a good person.
According to Cohen, the daughter said OReilly told him that, if she spends her time or more time at the mothers home, it will ruin her life.
OReilly and McPhilmy divorced in September 2011 and originally agreed to split custody of the children.

A divorce terminates or dissolves a marriage.
An annulment voids one that was never valid in the first place due to fraud, being under age, etc.
The laws concerning both are state specific. In CA, for example, you would still have a 6 mo waiting period before you could remarry, just as in a divorce, as a practical matter.

My amature understanding is that a civil divorce can occur for any reason in most places. It dissolves the legal contractual responsibilities of marriage between two people, they can remarry.
An annulment given by a church says that the marriage was never a valid marriage in the first place for one reason or another, making it as though the individuals were never married. However, they do acknowledge the legitimacy of any children which may have been born as a result of that union.
Some of the reasons given for an annulment could possibly include fraud, misrepresenting who one is, or is already married, or is closely related to the person they want to marry.
Not a fan of O'Reilly, but I agree.
I have always hated the guy and this is only more fodder. Can’t watch him. He is so in love with himself. He probably uses HS loofah, vibrator, and mirror now.
I feel bad for his kids. Glad they don’t have to spend time with that sap.

Well, custody of the daughter will only last about a year, when she will enter majority age. I guess we’ll learn what she really thinks by her actions after that.
At least that shows he was more committed to the marriage than she was.

While OReilly and McPhilmy were still married in 2004, former Fox producer Andrea Mackris filed a sexual harassment lawsuit against OReilly. Accused of threatening Mackris, bragging about attending a sex show in Thailand, and insisting that Mackris masturbate over the phone with a vibrator, OReilly settled with Mackris for an undisclosed amount on October 28, 2004.”
If you are a. Man in a divorce get ready to be slimed and maligned. I don’t believe anything when it comes to divorce records.

This sentence doesn’t even make sense. Who told what to whom.

It depends on the state. Here in GA, it’s a spreadsheet formula and is very cut & dry, based on the parents’ income, expenses, etc. No idea what NY State laws for this are.

Well she was married but I guess Bill wasn’t. She finally got sick of his philandering. Why do you think Fox News had to pay off that female producer back in 2009 or whenever? BOR was stalking her and calling up talking dirty. She had a tape and in order to suppress it they paid. My best friend is an attorney who is friends with an attorney for the law firm that defended BOR. She told me how much they had to pay. It was a lot.
I have met Bill OReilly. He has all the warmth and charm of an amoeba.
BS, my son recently lost on residency. His son was well coached by the mother, who high fives him after he came out of the judge’s chambers. Before she told him that his father was going to take him away from her, he would never see her or his siblings again. Tonight I will tell him the courts are against father’s even high profile father’s with the funds to fight. Judge took hearsay from mother and accepted it as fact. My son had facts to back all his accusations. Mother and family admitted under oath older sibling was violent and did drugs and worse. Even so living in that situation is deemed by courts in best interest of child. Govt matches support payments 60%, follow the money. Courts don’t want to lose those federal dollars.
LOL...the thought of an empty nest in a few years does not scare me a bit.
Put it this way, my oldest son rescued a dog that was lost, and I broke down and agreed to keep her. About 18 months ago, he moved out and got an apartment on his own. However, the apartment complex allowed dogs up to 50 lbs, and the shepherd mix hits the scales at 75 (though she should weigh 60).
She'd lived with us long enough to become part of the family, she's really a great dog. I've said a few times, "He left the dog behind when he moved out...we got the better end of the bargain." lol
I’m a dad three years into a divorce, and have de facto custody of my kids. Looks like a trial is going to be the only way to finalize my divorce, and I’m willing to roll the dice if she refuses to sign a deal. Ironically I also know BOR, his ex, and their kids. They are neighbors of ours. As tough as it is to go through, I think it’s always toughest on the kids. Without speaking to their situation, I think it’s even harder when everything to do with your divorce is made public.
Two people get divorced an one has “bad” stories about the other, while seeking to dip into that person’s wallet.
Shocking.
Never heard of a story like this before.
