A New York judge will hear arguments on Tuesday in a lawsuit that challenges Republican Sen. Ted Cruzs ability to run for president given that he was born in Canada.
State Supreme Court Justice David Weinstein will hear the claim of two men who contend that Cruz is not a citizen of the U.S. and is therefore ineligible to run for president, NBC has reported. Cruz was born in Alberta, Canada.
Barry Korman and William Gallo will argue that despite Cruzs mother being an American, the senator is not a citizen because such status cannot be passed from parent to child, Newsday reported.
The defense of Cruzs place in the election is being argued by the New York Board of Elections, which put Cruz on the ballot, NBC added.
Cruz, a lawyer, was elected to be a senator from Texas in 2012, Newsday added.
A natural born Citizen of the United States is a child born in the USA of two (2) U.S. Citizens. The parents can be Citizens by Birth or they can be Citizens by Naturalization after immigrating to the USA.
But to create a natural born Citizen of the United States both parents must be Citizens at the time the child is born in the USA.

Like a three legged stool if you take away any of these three citizenship legs of the Article II constitutional intent and requirement to being a natural born Citizen, i.e., being born with unity of citizenship in and sole allegiance to the USA, the child is born with more than one countrys citizenship and claim of allegiance/citizenship on them at their birth and thus they are NOT a natural born Citizen of the United States.
And as in the analogy of a stool designed to stand on three legs and it is missing a leg, it falls down, likewise the persons claim to natural born Citizenship fails if the person does not have all three citizenship legs required to be a natural born Citizen at the time of their birth.

As far as children of Vietnam vets go, I don’t know the answer from an academic standpoint. Were the mother and the father married at the time of birth?
What does that have to do with anything? Of course he's an American, all Canadians are Americans.

I hadn't heard that minimal standard before. He's probably a citizen...but just barely.
What he needs to be is born to TWO US citizens within the boundaries of US jurisdiction. Is the "Judge" somehow going to make all that happen?

Weinstein was appointed by Patterson, a liberal NY gov. So Weinstein may not like Cruz, may pull something off here. The enemy of my enemy is my friend...
Either these two clowns are completely ignorant or they're setting up this case for a certain loss.
My guess would be the latter.
He is not a natural born citizen according to the Constitution. He “may” be a citizen, naturalized. Time to reveal the sealed documents.
So when did Cruz become a citizen?
Either he applied to become one or he was born a citizen.

The parents DO pass on their citizenship to children. Thats what natural born IS. Place of birth is secondary to the test.
The fact that his father was NOT American AND his birth was in Canada is what makes Cruz NOT natural born American.
You cannot be natural born of two countries... it is ONE or the OTHER... This case with Cruz illustrates why the test includes citizenship of parents AND birthplace.
Cruz is NB of Canada. Canadian father + born in Canada.
Dual citizenship?... fine... but his American citizenship is naturalized.
That’s the great thing about America. What other county has a political system where anyone, no matter how humble their beginning, no matter where they were born, can immigrate here and become President?

He can be a ‘citizen’ of the United States, but he was not born on American Soil, so therefore he is not a ‘Natural Born Citizen’....there is a difference...
I would think this should be filed in federal court, not state court, since the matter of whether or not he is a natural born citizen is a federal determination (i.e., US Constitution), and not a state determination.
The question isn’t if he is “American” or even born a citizen. The question is whether he is a “natural born citizen” as stated in the constitution. Another low information reporter.
No you are either born a natural born citizen or you apply to be a citizen.
