A New York judge will hear arguments on Tuesday in a lawsuit that challenges Republican Sen. Ted Cruz’s ability to run for president given that he was born in Canada.
State Supreme Court Justice David Weinstein will hear the claim of two men who contend that Cruz is not a citizen of the U.S. and is therefore ineligible to run for president, NBC has reported. Cruz was born in Alberta, Canada.
Barry Korman and William Gallo will argue that despite Cruz’s mother being an American, the senator is not a citizen because such status cannot be passed from parent to child, Newsday reported.
The defense of Cruz’s place in the election is being argued by the New York Board of Elections, which put Cruz on the ballot, NBC added.
Cruz, a lawyer, was elected to be a senator from Texas in 2012, Newsday added.

Whether I like Cruz or not, is not the topic of this discussion, the topic is: Is Cruz natural born citizen by being born on Canadian Soil trying to run for POTUS in America....
And the SCOTUS should take this topic and debate it and make a ruling so this doesn’t happen again, after all that is their job to uphold and enforce the Constitution of the United States of America...
It’s simple: Does he, or does he not, have naturalization papers? If he does, he is not natural born. If he doesn’t, then he will have a US birth certificate which means he’s natural born. It isn’t rocket science.
I was born in a US military hospital in Stuttgart, Germany in 1966. My dad was in the Army and my mom was a housewife from South Louisiana. I have a German birth certificate and US naturalization papers.
When they returned from Germany they had to swear in front of a Federal Judge in New Orleans that I was their child. In return they were given a brown piece of paper that even today I must keep in a safe to ensure it doesn’t disappear. I have to have it to get my passport renewed.
When I turned 18 in US Navy boot camp, I was required to formally renounce any ties to Germany - in writing - to the US government.
Despite what the law may be *now* the law *then* is that the US military hospital was not US soil. And even though my parents were US citizens, I was not born on US soil. Therefore, I am *not* natural born and can *never* be president.
So - ask him. He either has a US birth certificate or he has naturalization papers.
I will be shocked if he goes to the merits of the case and doesn’t dismiss for lack of standing.
People that insist on their Constitutional right to have a natural born president are derided as “birthers”.
People that insist on their Constitutional right to bear arms are called “gun nuts”.

You are as persistent as you are wrong. There is no ‘three legged stool’ test anywhere but in your head. That is NOT the law. Since you quote Vattell, why not use HIS test; that the children inherit the condition of the parents.

First all the issue is not if Cruz is an American but whether he is a natural born citizen.
Secondly, this is a federal constitutional question and should be decided by a federal court.
This appears to something it isn’t. If Cruz was nominated and then challenged in federal court and the court DQ’d him, he’d be effectively handing the election over to the socialists.

I’m not sure he is a citizen. We only have Ted’s word that his mother was not in Canada long enough before his birth to become a Canadian citizen. We know his father became a Canadian citizen & it may be his mother became Canadian too. Who knows. He would unseal the records if he didn’t have something to hide.
We’ve never seen his CRBA or his passport.
Any citizenship that is decreed by a law enacted by Congress is naturalization. You assume that the naturalization process only consists of what immigrants go through.
There is no proof that Arthur was born in Canada, there was only speculation.
Citizenship, specifically natural born citizenship, is a requirement to be President.

Unfortunately, this new crop of “judges” we’ve got over the past 10 years don’t care about no stinkin’ laws. It’s how they feel in their heart. “What would Europe do?”
My educated guess is that Weinstein says 'eligible' so that, for instance, someone born in Pakistan and raised by wolves can enjoy running for President someday ...

In the event of a 4/4 split, the lower court ruling prevails.
I agree, they have really failed America....Roberts is being blackmailed; no body dares stand up and say how it is for fear obuma will do something to them...McConnell is being blackmailed with half of the Senate, and the same thing in the House...
If only people would have stood up like are beginning to now to vet obuma, we wouldn’t be in this conversation or the mess we are in today...
Obuma has NO business being POTUS, this is the very reason of ‘Natural Born Citizen’....
