Phone .. imminent domain ?

There is a good posiblity that apple CANT break the phone and just does not want to be seen by there clients as helping the .gov

Do you enjoy spreading rumors. Donald Trump did NOT take an old lady’s property. WHY am I doing this again..YOU know better. He offered here a MILLION $$...she turned it down and KEPT her shack!

Let Apple download the text...review it and then consider what they want to do....and if they have revealed any of the software components.

This is after the fact for a phone of a dead murderer. Also, the dead have zero rights or expectations of privacy.

There is not even a warrant needed. I can't see this happening in WW2 and an American company refusing to help decipher a Nazi transmission.

Apple is not being asked to open the phone. Apple is being compelled to write software to unencrypt the phone. There is a huge difference. The FBI and NSA don’t have that talent? If that is true, we are in huge trouble.

The know the phone number, why not subpoena all of the phone records?

The government simply wants the ability to unlock iPhones. Too bad. Hire better people.

If Apple can open the phone, and refuse to, they are hiding potential evidence in a terrorist attack...not really difficult to figure out.

You are correct. If we were in a state of declared war the executive branch is given almost unlimited power. Is it any surprise that we no longer declare war?

Right now we are not in a declared state of war against anyone.

Of course. The key here is that a judge has ordered it. As an analogy, I would not permit a police officer to just enter my home to look around. But if that cop has a search warrant signed by a judge, then I will (and must) step aside.

If they do that, then they have set a precedent, and will have to do it for everyone else. Once you jump off that cliff, there's no going back.
