If the Republican's lose this argument, we shuld give up on them.
The Dems have a long history with Eisenhower, Nixon, Reagan, and Bush, of being on the record that the Republican President cannot exercise a federal bench power of appointment, in one case with 13 months left in his term.
The R's need to keep that out front in the PR dispute that is forthcoming.
Further, I can think of no reason why Barry in the White House would not step up with a recess appointment of Eric Holder tomorrow morning.
The R's need to make conciliatory statements about considering and voting on the appointment every day until next Tuesday.
McConnell needs to step up and get a technical session in process tomorrow morning and end the recess agreement. If Barry steps up with his recess appointment while the R's are sitting on their thumbs, we should never forget it.
