've never started a thread (in 16 years), but I have a question for discussion.
Assume Ted Cruz is the Republican nominee. The Democrat candidate files lawsuits challenging Cruz's Natural Born Citizen status in two or more appellate districts. In one, the Court of Appeals rules that Cruz is a Natural Born Citizen and must appear on ballots. In another, the Court of Appeals rules that Cruz is not a Natural Born Citizen and cannot appear on ballots in that district.
Both cases are appealed to SCOTUS, but no replacement for Justice Scalia is nominated and confirmed. In both cases the Supreme Court splits 4-4. Would the matter revert to the decision of the Appeals Court so Cruz would be on the ballot in some states but not others.
To complicate the matter further, some states, California for example, span two appellate districts. If the decisions conflicted, Cruz would appear on some ballots in a state but not others.
What happens now?
That depends on what it is you're trying to conserve.

It won’t even get into district court, let alone an appellate court.
The Courts ENTIRELY lack jurisdiction, for several reasons, not the least of which is that there is no law that can be said to have been broken. This is a political issue, not a legal one.
The question of Cruz's citizenship aside, you're out of your mind! Illinois is THE MOST CORRUPT STATE IN THE COUNTRY and has no business deciding ANYTHING.

Just out today, plus a story that Rafael mom renounce her citizenship like Rafael Sr. did.
No court has jurisdiction to take the case you are postulating, and if you don’t know that, you are too uninformed to have an opinion on the subject.
It would cause a constitutional crisis which would then go into full blown civil war in a matter of 2-3 months.
The only way to fix things now is cleansing with fire.
You would be better advised to worry about the composition of the Court if Cruz does NOT prevail. Should that happen, God help us all.

They did not. They ruled in favor of Cruz on the question you asked.

Up until the death of Justice Scalia you were probably right. But if the four liberal justices have any wiggle room, and they do... they will decide against Cruz. This will deadlock the Supreme Court. The lower court's ruling will stand. Whoever files one of these lawsuits will do it where they will get the most liberal panel of judges on the appeal. Some of the most liberal judges in the country will get to decide the fate of the most conservative politician in the presidential race. If that does not strike fear into your heart, I don't know what will.
