After the sudden death of conservative Supreme Court Justice Antonin Scalia, President Obama has the opportunity to move the countryâs highest court toward the left by tapping a more liberal-leaning successor.
Immediately after news of Scalia's death broke, diverse options for the top job were being floated along with a debate online among Senate leaders about whether lame duck Obama should be the one to nominate the next justice.
"The American people should have a voice in the selection of their next Supreme Court justice," Senate Majority Leader Mitch McConnell (R-Ky.) said Saturday in a statement.
"Therefore this vacancy should not be filled until we have a new president.â
Senate Minority Leader Harry Reid (D-Nev.) quickly fired back saying that "it would be unprecedented in recent history for the Supreme Court to go a year with a vacant seat."
"Failing to fill this vacancy would be a shameful abdication of one of the Senate's most essential Constitutional responsibilities."
Legal experts think Republicans might block an Obama appointee until he's out of office, leaving the court with a gaping vacant seat for nearly a year.
"I think Republicans will make every effort to block the nomination," Stephen Wermiel, Professor of Law at American University Washington College of Law told the Daily News. "Even to the point of shedding blood in the aisles of the Senate if they have to."

Next year with a Republican President and Republican Congress, they should start stacking the Supreme Court with more Justices.
Congress can change the number of justices on the Supreme Court without a Constitutional amendment. They did it several times in the 1800’s. Maybe it’s time they at least doubled the Court to 18. With more members, it wouldn’t be so dependent on one member to tip it this way or that.

Yes I’m walking back the knee jerk Holder prognostication. He’s a natural born citizen. The Indian who was not even born here put on the Supreme Court is more like a standard Obama move.
No way do we allow someone born outside America to be a SCOTUS judge!! NO EFFING WAY!!!
Well, Elena Kagan hasn’t “come out” yet, but it’s not as if nobody knows.
She was appointed prior to the gay marriage vote, so that worked out for Obama’s agenda—as planned.
That’s one thing I’ve noticed about Obama—he plans ahead.

Not necessarily one who openly admits to being a tranny, and not necessarily obvious in appearance. I’m thinking possibly even a female-to-male tranny. One with an add-on. Seriously. Not joking here.
The person will be somebody no one’s ever heard of, with seemingly irrefutable qualifications and experience.
S/he will “present” as male or female, but will be just androgynous enough in appearance to raise questions. And then, when questions are raised, Obama doubles down on his appointee’s “qualifications” while excoriating the American people as a bunch of hateful bigots with dirty minds, looking in people’s underwear, bla bla blah.
It’s the kind of thing Obama would do, just for giggles. Just watch.
I agree and for once I doubt whether Mitch McConnell is going to waiver. He wants to pick the next SCOTUS justice too badly to let Blam do it. He will go to the mattresses on this one. Othewise the GOP base will hang him on a lightpost out on Pennsylvania Ave.
On a side note, a few weeks back a federal court ruled that the administrations claims of executive privilege were invalid. This is by no means over and I expect that Holder is in jeopardy of a perjury charge. They would have never invoked executive privilege unless they were hiding damning evidence.
Buy the way wasn't Holder held in contempt of congress?

The nominee's main characteristic has to be striking terror into the hearts of the GOP Senators up for reelection, because the prime directive (per the donor class) for a GOP candidate has to be "no hating".
Because it is his last year in office, and because there is a (more or less) Republican majority in the Senate, Obama will have to avoid those who would be his first choice given his druthers. Not unlike Reagan with Kennedy.
IIRC, RWR’s first choice was Douglas Ginsberg whose weed smoking with students while teaching at Harvard ultimately did him in (different times, obviously.. that wouldn’t matter today). RWR had another choice in between but it was batted down in favor of Kennedy who, it was assumed, would win Senate confirmation without much problem.
So the very worst case scenario is that Obama would be forced to nominate a more “middle of the road” candidate. Of course, coming from where he’s from “middle of the road” has a different meaning for him than it does for us.
Second Amendment issues. That’s my primary concern. That and Illegal Immigration.
I can count on a naturalized Indian to vote poorly on my two issues.
The answer is NO.
We have enough native born traitors. Why do we have to put an Indian one on the Supremo Court?
In his present court (DC Circuit) he was sworn in on the Hindu Bhagavad Gita...not a Bible
