FOX News: Obama Can Appoint Supreme Court Justice After Senate Adjourns on January 3rd

Nightmare scenario-

FOX News reported this afternoon that Barack Obama can appoint a left-wing Supreme Court Justice after the Republican Senate adjourns on January 3, 2016.

Obama will then have 17 days to nominate a far left justice to the Supreme Court.

11 of 12 previous recess appointments were approved by the senate.

This came up in discussion after news broke that conservative Justice Antonin Scalia was found dead today.

This would be his last 'eff-you' to the American people before he leaves office.

God help us.

I don’t think he will wait that long.

IMHO he won’t just want to appoint Scalia’s replacement.

He will want to do it in an impudent way that shows his contempt for the constitution while thumbing his nose at the the republican congress and senate

He will say in effect “Up Yours! Do something about it.”

Even if they adjourn sine die earlier than that, all recess appointments expire the moment a new Congress is sworn in.

No-- re-read Article II. A recess appointment lasts until the end of the next Congressional session (so, for about a year).

That's automatic. Recess is another matter. There's a 3 month recess June, July, August?? when the politicians go home and a recess appointment can be made.

There's a way to have no effective recess.

The court runs from October till about the end of June so it would have to occur during that spring/summer recess but would only be good until the end of Obama's term...so nothing will be gained.

Obama got shot down by the courts on some of his appointments. He said they were in recess. The court said...like hell they were.

I don’t know. I don’t trust them. The damage they could do with 5 votes on SCOTUS for even a day could be immense.

The head dictator of the foreign regime that is now running America went on TV tonight supposedly to pay tribute to SC justice that just died today,
But he didn’t leave it at that. As usual, he has to let us know he’s in charge and HE will be the one who decides on the successor.
At every turn, ordinary Americans are slapped down, fleeced of their hard earned wages, exposed to human diseases shipped in here by the government, exposed to Islamists deliberately brought in here, OR KILLED.
The death of America is at hand.

They don’t mean what they’re saying. In Jan 2017 a NEW senate is seated. Obama is in power until Jan 20.

1. If it’s a democrat senate he can win via nuke option.

2. The old senate MUST end and a new senate must begin. That. entails an adjournment of the old senate.
