That was a stupid thing for the Cruz campaign to do. I bet the Iowa SOS got a lot of calls.

There is not an opponent of Ted Cruz anywhere in the world that is not happy to see that headline.

And the headline of every major US Newspaper in the country tomorrow morning.

On the eve of the caucus.

And, he did it to himself. There is nobody to blame but himself.

Not even Mark Twain could think up a story like this. It's up there with the Jumpin' Frog Jubilee of Calavaras County.

And while I disapprove of the mailer, it should be pointed out that Secretary of State Pate is a Trump backer.

Well .. looks like Daddy is going to have to do a little reprimanding to his underlings.

Time to shake the tree and see what falls out.

I can guarantee you it won’t be a conservative. This is about the 3rd such event .. and Cruz better plug the hole very quickly.

I want to know who’s brilliant idea it was to do the mailer in the first place. Remember, Cruz may know the Constitution, but he is not required to know all the laws of each state .. election or otherwise.

“Today I was shown a piece of literature from the Cruz for President campaign that misrepresents the roll (sic) of my office, and worse, misrepresents Iowa election law,”

What kind of SecState is it that cannot write English?

The word is “role” unless his office is rotating. Maybe it is. The Iowa GOP establishment from the Gov down is in the Trump camp.

I was surprised to learn the Cruz Iowa State chairman is Matt Schultz, a former Iowa Secretary of State. Shouldn’t Schultz have know how bad this would look to Iowa voters. Didn’t he learn anything when he was the Iowa Sec of State?

Statement from Secretary of State Paul Pate Regarding Misleading Mailer from Cruz for President Campaign

State of Iowa Seal

State of Iowa Seal

DES MOINES - Today I was shown a piece of literature from the Cruz for President campaign that misrepresents the role of my office, and worse, misrepresents Iowa election law. Accusing citizens of Iowa of a “voting violation” based on Iowa Caucus participation, or lack thereof, is false representation of an official act. There is no such thing as an election violation related to frequency of voting. Any insinuation or statement to the contrary is wrong and I believe it is not in keeping in the spirit of the Iowa Caucuses.

Additionally, the Iowa Secretary of State’s Office never “grades” voters. Nor does the Secretary of State maintain records related to Iowa Caucus participation. Caucuses are organized and directed by the state political parties, not the Secretary of State, nor local elections officials. Also, the Iowa Secretary of State does not “distribute” voter records. They are available for purchase for political purposes only, under Iowa Code." Paul D. Pate, Iowa Secretary of State

I mean, these people are going to destroy the reputation of the Republican Party that will have no small effect in the General, these antics will not be forgotten and will be brought up front and center by the Democrats. These people are building the disaster of a Republican loss to either Hillary or Sanders, when until about a month ago I felt pretty much any Republican could beat Hillary but now, besides that Hillary may not even be the Democratic, whether it is Hillary or even socialist Sanders, I am watching these Beckism nutjobs and these type of antics which just scream lies and borderline illegalities, I mean if thia “team” gets their guy the nomination there isn’t going to be a Holy Saint coming out of the sky performing a magical miracle to win the General, it ain’t going to happen and their guy is literally going to get massacred by the other side and America is not going to elect their guy and even Sanders would bet him. But some of these nutjobs are now destroying the reputation of the Republican party, such that literally all the candidates whoever wins the nomination will be damaged because of these few fools.

Ted Cruz, the "Constitutional Attorney", the "smartest lawyer in the room", by sending these "Voting Violation" mailers, in my opinion, violated the following federal election laws. Many States have similar laws.

The following is an image of a mailer Senator Ted Cruz sent out intimidating and threatening voters. It contains voter information and the information of the voter's neighbors.

It threatens "follow up notices" with no doubt information about if the voter voted in the caucus.

It attempts to intimidate voters by threatening public disclosure to neighbors of a person's voting record.

One must ask what does Senator Ted Cruz expect the person receiving this notice should do to their neighbors for not voting as Senator Ted Cruz demands, and what might happen to the voter if the neighbors are informed they have not voted as Senator Ted Cruz expects?

These are direct threats and intimidations in violation of federal election, civil rights, and postal laws.

The following PDF document outlines the federal election laws and the government's position on such matters for the purposes of prosecutions in such matters.

Federal Prosecution of Election Offenses Seventh Edition, May 2007

The following sections are from the above document.

42 U.S. Code § 1973gg-10 - Criminal penalties (violation of election law)
A person, including an election official, who in any election for Federal office-
(1) knowingly and willfully intimidates, threatens, or coerces, or attempts to intimidate, threaten, or coerce, any person for-
(A) registering to vote, or voting, or attempting to register or vote;
(B) urging or aiding any person to register to vote, to vote, or to attempt to register or vote; or
(C) exercising any right under this subchapter; or
(2) knowingly and willfully deprives, defrauds, or attempts to deprive or defraud the residents of a State of a fair and impartially conducted election process, by-
(A) the procurement or submission of voter registration applications that are known by the person to be materially false, fictitious, or fraudulent under the laws of the State in which the election is held; or
(B) the procurement, casting, or tabulation of ballots that are known by the person to be materially false, fictitious, or fraudulent under the laws of the State in which the election is held,
shall be fined in accordance with title 18 (which fines shall be paid into the general fund of the Treasury, miscellaneous receipts (pursuant to section 3302 of title 31), notwithstanding any other law), or imprisoned not more than 5 years, or both.

18 U.S. Code § 594 - Intimidation of voters
Whoever intimidates, threatens, coerces, or attempts to intimidate, threaten, or coerce, any other person for the purpose of interfering with the right of such other person to vote or to vote as he may choose, or of causing such other person to vote for, or not to vote for, any candidate for the office of President, Vice President, Presidential elector, Member of the Senate, Member of the House of Representatives, Delegate from the District of Columbia, or Resident Commissioner, at any election held solely or in part for the purpose of electing such candidate, shall be fined under this title or imprisoned not more than one year, or both.

18 U.S. Code § 245 - Federally protected activities
(b) Whoever, whether or not acting under color of law, by force or threat of force willfully injures, intimidates or interferes with, or attempts to injure, intimidate or interfere with-
(1) any person because he is or has been, or in order to intimidate such person or any other person or any class of persons from-
(A)
voting or qualifying to vote, qualifying or campaigning as a candidate for elective office, or qualifying or acting as a poll watcher, or any legally authorized election official, in any primary, special, or general election;

(5)
any citizen because he is or has been, or in order to intimidate such citizen or any other citizen from lawfully aiding or encouraging other persons to participate, without discrimination on account of race, color, religion or national origin, in any of the benefits or activities described in subparagraphs (1)(A) through (1)(E) or subparagraphs (2)(A) through (2)(F), or participating lawfully in speech or peaceful assembly opposing any denial of the opportunity to so participate- shall be fined under this title, or imprisoned not more than one year, or both; and if bodily injury results from the acts committed in violation of this section or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire shall be fined under this title, or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title or imprisoned for any term of years or for life, or both, or may be sentenced to death. As used in this section, the term “participating lawfully in speech or peaceful assembly” shall not mean the aiding, abetting, or inciting of other persons to riot or to commit any act of physical violence upon any individual or against any real or personal property in furtherance of a riot. Nothing in subparagraph (2)(F) or (4)(A) of this subsection shall apply to the proprietor of any establishment which provides lodging to transient guests, or to any employee acting on behalf of such proprietor, with respect to the enjoyment of the goods, services, facilities, privileges, advantages, or accommodations of such establishment if such establishment is located within a building which contains not more than five rooms for rent or hire and which is actually occupied by the proprietor as his residence.

18 U.S. Code § 241 - Conspiracy against rights

18 U.S. Code § 242 - Deprivation of rights under color of law Whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States, or to different punishments, pains, or penalties, on account of such person being an alien, or by reason of his color, or race, than are prescribed for the punishment of citizens, shall be fined under this title or imprisoned not more than one year, or both; and if bodily injury results from the acts committed in violation of this section or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire, shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse, or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death. Ted Cruz is a US Senator and subject to this law.

18 U.S.C. § 1341 - Mail Fraud Whoever, having devised or intending to devise any scheme or artifice to defraud, or for obtaining money or property by means of false or fraudulent pretenses, representations, or promises, or to sell, dispose of, loan, exchange, alter, give away, distribute, supply, or furnish or procure for unlawful use any counterfeit or spurious coin, obligation, security, or other article, or anything represented to be or intimated or held out to be such counterfeit or spurious article, for the purpose of executing such scheme or artifice or attempting so to do, places in any post office or authorized depository for mail matter, any matter or thing whatever to be sent or delivered by the Postal Service, or deposits or causes to be deposited any matter or thing whatever to be sent or delivered by any private or commercial interstate carrier, or takes or receives therefrom, any such matter or thing, or knowingly causes to be delivered by mail or such carrier according to the direction thereon, or at the place at which it is directed to be delivered by the person to whom it is addressed, any such matter or thing, shall be fined under this title or imprisoned not more than 20 years, or both.
