Ted Cruz's fmr. professor says Cruz is a hypocrite on the Constitution VIDEO

Thursday following FBN's broadcast of the Republican presidential debate, Harvard constitutional law professor Laurence Tribe attacked Sen. Ted Cruz (R-TX) 97%, one of the participants in last night debate, for his stated on reasoning for his eligibility to run for president of the United States.

According to Tribe, Cruz applies a double standard to his interpretation of the Constitution, to which he deemed Cruz to be a "constitutional opportunist" and a "hypocrite."

"I've done a lot of historical research on it, and so have a lot of other people, and the best evidence seems to be that what they meant in 1788 was something more than just citizen from birth," he said. "They actually meant a citizen whose birth was sort of natural, not in a biological sense but in the sense of connection to the land. The idea was, that it was something that Congress couldn't change, unlike the naturalization process, which Congress has monkeyed around with all the time. I mean, for example, in 1934, the first time it said, you can be a citizen who doesn't need to get naturalized as long as your mom was an American citizen. And that's ultimately the basis on which Cruz has to rely.

The funny thing is, that the kind of guy Cruz is, he's always been this way. When he was my student he was this way. He's always said the Constitution always means the same thing that it meant when it was adopted. That's why he made this funny joke to Trump, you know, saying, the Constitution didn't change since last September. Well, he thinks it didn't change since 1788 when it comes to gays and, you know, women and other things. But when it comes to his own ambition, he's suddenly becomes what he accuses me of being, and it's a pretty true accusation, a judicial activist. That's not the guy he is normally."

"He's being a constitutional opportunist, a hypocrite," Tribe continued. "It's sad, because he makes light of it, but it is a genuine open question, and there's no way of getting around it. Like if he's the nominee, it won the be hard to imagine some secretary of state somewhere simply refusing to put him on the ballot on the ground that that secretary of state is also an originalist and thinks, if you weren't born on the land of the United States, then you just can't run. At that point, somebody would have to sue them, whether it's Ted Cruz himself as the nominee, if that's what we've got, or the Republican National Committee. There's no way to avoid an issue like that going to the Supreme Court. And the irony is, the liberals on the court, assuming they all voted according to principle, as opposed to politics. It isn't always that way, the liberals on the court, the activists would go with Cruz, and the originalists if they were true to their position like Scalia, would vote against him."

HUMPH, HUMPH :-)

There are two areas that can be discussed; what would be right under some theory, and what is likely to GO DOWN vis a vis Cruz.

No, our dear USSC is not an apolitical body. I think that notion went away last summer if it ever could have been entertained.

Let’s try to GET SOME CONTROL BACK over the situation. Then our theoretical niceties have a chance at traction. I think a Trump spearheaded presidency is plausibly going to lead to this, in the theory I posted further above. Trump gets out the bulldozers when something is not what he likes. He may grudgingly accept the Constitution but he is going to push. And when the stars of the Truth In Marriage constellation are already begging for something to happen, then when the stars of Trump Wants This shine on the situation too... heaven and earth are going to shake.

The result won’t be all clean and neat but it will blaze a path for returned control to We The People. Now your theories will actually have a chance, Mr. Bedford.

Just trying to get people to lighten up. We don’t have to all be enemies. It would be better to be unified as enemies to the devil who really IS grim. The devil only offers you a pleasure to get you to plunge into a tragedy for its sake.

Ted's father was NOT a naturalized American Citizen until 2005, which automatically denies Ted the NBC ! He's a citizen, but NOT eligible to run for the presidency and neither is Rubio, nor was Jindal and Haley can't be chosen for VEEP, because SHE isn't an NBC either.

Correct nopardons, as I'm sure you know. The inventiveness of people who are being creative propagandists can discourage those looking for a little truth.

I had a hard time finding any of Cruz statements about citizenship that were true, and while Tribe is definitely liberal, he values his somewhat tarnished (Kagan had to cover for Tribe, one of whose books was full of plagiarism) reputation as a "scholar". Cruz certainly knows that the parents of someone born on sovereign soil need only be citizens. What did a lie do for him? It suggests that Cruz has little respect for the intelligence and knowledge of the electorate. Tribe corrected him, retroactively, in Tribe and Olson's letter to the SR 511 hearing in the Judiciary Committee.

Cruz cites, and must have read Wong Kim Ark, Wong Kim born on our soil to "domiciled" parents, not naturalized because China forbade its subjects repudiation of their citizenship. Wong Kim's first breath, Cruz's explanation for what law made him natural born, was on our soil. Wong Kim, in 1897 was declared a naturalized citizen, based upon the 14th Amendment. Cruz has lied about almost every Constitutional issue he comments upon, though that is probably because most of those questions involve eligibility.

Tribe has carefully avoided lying, just as his student and advisee Obama did, Obama has not claimed to be a natural born citizen. Tribe cited as reasoning for making McCain natural born, just as Mark Levin did, the 1790 Naturalization Act from the 1st Congress, not bothering to mention that it was entirely rescinded by Madison and Washington in 1795, with the phrase natural born citizen replaced by "citizen". The Tribe/Olson letter is what good attorneys often do, misdirect by omission and skillful argument, demonstrating mastery of our language. That is part of why Madison and the other framers kept definitions out of Constitution. The 1790 Naturalization Act is, after all, a naturalization act. Congress only has authority to modify its "Uniform Rules for Naturalization", Article 1 Section 8. Cruz has simply lied. He claims to be, or some claim that he is, a Constitutional scholar. He would not so misrepresent the law. He simply lies.

About half the discussion that has happened in this thread could be boiled down to: there’s a serious shadow over Cruz. The proverbial cards (actually the good Lord) want him in the Senate.

Sometimes it is hard for us to kick against the goads.

He is not leading in Iowa. He (Cruz) is losing by 4.

The last poll I saw had Cruz up by 3?

Sounds like a margin of error difference. But I don’t think this is Cruz’s biggest hazard.

You are 100% correct and I grow weary from typing and endlessly retyping the facts, to those who don't know any, only to have them leap down my throat and call me names or worse.

To put it simply and bluntly, TED CRUZ IS A LIAR! He has lied about so many different things now, that my head is spinning. His supporters claim that he is "brilliant"; however, everything that he has done, since he ran for the Senate, has been lie, deceive, get others to lie for him...giving supposed credence to his lies and someone/s need to give him his true comeuppance!

I have NEVER seen so much abject stupidity and bilge posted to FR, since this site began.

For what it’s worth, a “lie list” could be informative. I think we want to be objective here, not the least reason that a lot of mavens are looking in on our discussions here. We are a recognized think tank whether or not we realize it, and it’s come to light a few times. No gratuitous smears please, but when we “handicap” the situation we want to know where we stand. That’s a basic premise of truth. I think we are entering into a season of truth and it is going to be welcome because it will presage the movement of God.

The lovefest escalated this week when Putin, talking just after his end-of-year press conference, called Trump “a very bright and talented man,” as well as an “absolute leader” in the race for the presidency. Trump, appearing on MSNBC’s “Morning Joe” on Friday, returned the warm embrace, saying it’s nice “when people call you brilliant, it’s always good, especially when the person heads up Russia.”

And when pressed by co-host Joe Scarborough about the number of high-profile murders of journalists who have been critical of Putin, Trump was reluctant to offer any harsh words. “He’s running his country, and at least he’s a leader, you know unlike what we have in this country,” Trump responded.

After further questioning, Trump responded, “Well I think our country does plenty of killing also, Joe,” he said. “So, you know. There’s a lot of stupidity going on in the world right now, Joe. A lot of killing going on, a lot of stupidity.”

We have no virgin births or immaculate conceptions here to play with here on earth.

After we look at everyone with all flaws and strengths taken into account, we need to handicap our horse races with godliness. I suggest using grace as a principle. If we CAN look at something in a GOOD way and we have no further definitive information, DO look at it in a GOOD way. (There are some virtues in the Putin situation; e.g. he’s managed to unite a country. Trump never issued a blanket endorsement. That is what binary thinkers seem to require to be implied.)

However, heading for a trap is not something that can be viewed from a good angle except it takes the person on a different trajectory.
