Republican presidential candidate Ted Cruz was born in Canada; he is not a "natural born citizen," and he is not eligible to be president.
And this is an issue that isn't going away, contrary to The Sacramento Bee's assertion, ("Trump's 'birther' lunacy, the sequel," Editorials, Jan. 7)
The Constitution is very precise: "No person except a natural born citizen ... shall be eligible to the office of President." The founders knew what they meant.
John Jay, later the first chief justice of the United States, wrote: "the commander in chief of the American army shall not be given to, nor devolve on, any but a natural born citizen." Later, one of the authors of the 14th Amendment, Rep. John Bingham of Ohio, wrote: "Who are natural born citizens but those born within the Republic?"
Congress has passed a statute that says if one of your parents is a U.S. citizen, you are an American citizen, too, no matter where you were born. Cruz's mother was born in Delaware. That makes him a "citizen" by statute, but not a "natural born citizen" within the meaning of the Constitution.
If both of Cruz's parents had been American-born, Cruz would have a stronger case. However, his father was born in Cuba.
Every other president and presidential candidate in our history was born either within the United States or one of its possessions. At no time ever was Calgary, Canada, where Cruz was born in 1970, a U.S. possession.

Mark Levin says he is qualified which is all I need to know.
As we used to say in the military, ‘If you don’t have the facts, dazzle them with bullshit”. Mark “Can You Hear Me Now” Levin, apparently subscribes to the same approach to making a point.
Since nobody had standing to confront the issue of NBC over Obama in any court, neither will anyone who questions Cruz- ya think?
Personally, as I stated last year- NBC requires more than citizenship- more like two parents who are citizens and born in the US or on official US business elsewhere ( as in McCain etc).
I notice that nowadays the proprietor isn’t threatening to can any one wo voices any question over Cruz’ NBC status. Hmm.
All that said, out of the bunch of RINOs etc running, I like Cruz’ position and person best.... and I would vote for him over Trump in the MO Primary.
Yes, I’m a New York liberal NY values person who also is a neo-Confederate Nazi.
Both Haley & Jindal are putzes. That’s New Yorkese for fake conservative.
Thanks for the correction.
Thanks for noticing the mistake, or confusing presentation, or whatever it was! I tend to type a little slower than my brain is working, and it’s real common for me to type the opposite of what I am thinking.
“He was a citizen at birth, did not need to go through a naturalization process, heâs a natural born citizen”
An anchor baby is a citizen at birth, too..
Yeah, my correction needed correcting.
Or something like that.
Oh that's right, you're the one that talks like a gangster.
who also is a neo-Confederate Nazi.
So, is that some form of US patriotism? You seem confused.
Yes. The Democrats would love that candidate and the Trump birthers couldn’t win that one either.
Yeah, I agree, it should be done before a person announces intent to run. Like you can’t even announce until you know for certain that your eligibility cannot be challenged, and such has already been certified by some authority.
Why waste time.
See: Rubio/Jindal.
hoosiermama, that Oz person is willfully misrepresenting the law. He claims to be a semi-retired DC lawyer, he knows the Rogers v. Bellei case (I sent it to him today), and he is purposely misstating that the law makes Cruz NBC. Cruz is naturalized, period. Oz signed up Oct 2015. All the hallmarks of political operative, psyops. If this was my forum, I’d zot him.
What I want to know is, who, of the horde of candidates is not on the ballot in all 50 states?
And why are they still being allowed to be muck up the debates?
Congress can pass a constitutional amendment striking out the words “native born” and require the President to be a US citizen, period.
That would open the Presidency to both naturalized and native born Americans.
If you think archaic 18th Century wording should disqualify an American born in Calgary from running for President, its stupid.
Why can he be a loyal Senator or Congressman but not President? That’s what its really all about.
You don’t know me so cut the crap. Cruz was my first choice before Trump came into the race. I was pissed over TPA and didn’t try to hide it. Do you have a good answer why Ted voted to bring TPA out of cloture?
To tell the truth, the Cruz supporters are the ones who really turned me off Ted. I have found myself liking him less and less with each of these insane back and forths.
I absolutely gave a lot of thought to my opinion on natural born. Didn’t get past definitions though before I questioned it. Natural born is on the land, of the soil. Naturalized is citizen ship granted by law to someone born on foreign soil Those definitions are what drove my opinion.
Why waste time.
Agreed. Not just for POTUS, but for Representatives and Senators as well.
Might as well. I got nothing against making sure everyone is on the level.
Just beautiful. I am a huge fan of the southland and a student of the Civil War. It hurts me to see the memory of greats like Robert E. Lee and Stonewall Jackson and handsome Jeb Stuart erased from history. Nikkie Haley is a disgrace as are all the other cowardly and un-American politicians who support erasing our history.
Thank you!
I’m not sure, I do know that I am personally not interested in hearing from anyone other than Trump and Cruz.
Everyone else can take a walk.
