Oh Lord......well it seems like I will win this one anyway. Looks like Cruz couldn’t even remember voting against the iowa farmers and blamed his staff. Nice to have another possible President blame others......well at least Cruz will fit right in.

What do you think ‘drove people from the land’ is? sounds like conquest to me. We also purchased large parcels or conquered large parcel from other who had conquered the land.

I am not sure what point you are trying to make. I was attempting to explain that ‘eminent domain’ is not written into the constitution. Are you trying to say that driving people from their land was NOT a purchase or a conquest. Maybe it was a negotiated settlement.

The only place that I am aware of where eminent domain does not apply is base upon the treaty whereby we conquered land from Mexico. The treaty stated that the U.S. would recognize the Mexican Land Grants that could be proven and direct ancestral lineage.

Only Government has the power of eminent domain. Private enterprises do not. That said the government has the ability to claim private property and give/sell to private enterprises if, in their opinion, it is for public good.

In the late 60’s the City of Los Angeles used E.D. to give land to a non profit to build a museum. In the 70’s the Supreme Court allowed home/land along a river to be claimed so the developer could build much more expensive homes. The court found that if the City claimed benefit due to higher property taxes then it was justifiable. So the government can take your home and sell it to someone else just to benefit from the higher assessed value. Like it or not that is the current state of affairs with our Supreme Court.

Public use is a very wide open statement. It can mean for a military base, for an oil pipeline, for an apartment building. And it has been used for those type of issues.

In the 70’s the supreme court found that taking someone’s home so that the government can get higher property taxes is perfectly legal.

We purchased land from the indians, or outright took it from them. Indians were moved onto reservations and then we moved them off the land reserved for them when we decided we wanted their land for settlement. This happened in Ohio and other places.

It’s not as simplistic as your original comment made it out to be. Hence my comment to you.
