The police never arrested her though they investigated the shooting. However in February, nearly two years after the assault, James was indicted on charges of voluntary manslaughter and negligent use of a firearm. In November she appeared before a judge for a bench trial. She took the stand and pleaded self defense. The prosecution presented no witnesses and no pictures of her injuries were introduced to bolster her case. Following testimony, the judge took only a few minutes to find her guilty, saying saying that no "reasonable person" would have acted as James had. She now faces up to seven years in prison; sentencing is January 6.

The lady is a member of a minority and has been subjected to domestic violence both growing up and in previous relationships. Her attacker was Black. Women in the under class for whatever reason have not learned to avoid such circumstances. I suspect not having a stable family life in childhood and having rotating boyfriends in her adult life is the primary reason. Part of me blames the victim for her situation. And the other part, the liberal culture. This is a consequence of the "War on Poverty" and the welfare state that rewards single-parent women with more money for bearing children. It's a repeating set of circumstances that won't be solved by just throwing more money at those in this situation.

Soundds like she had a crappy lawyer who didn’t bother to defend her adequately. And at least her lawyer should have gotten her a jury trial.

But she wasn't done. She reached under her pillow for a loaded handgun, which she had purchased for protection a year before.

She closed her eyes and fired.

Lumpkins died of a gunshot wound to the heart, according to an autopsy report.

 

 

Bad Woman! Bad! She should have called 911. She should have gotten a restraining order. She should have realized Climate Change was at fault.

Sounds like a valid charge for someone who pulls the trigger with their eyes closed. "She closed her eyes and fired. "

So a reasonable person would have just laid there and allowed herself to be beaten to a pulp? Judged is whacked.

she needs money for better lawyer to appeal. that her lawyer didn’t introduce evidence in her favor and not having a jury trial a big mistake.

Why the hell did she agree to a bench trial?

This case stinks (as related here), and I bet at least one or two on the jury would have had none of it.

I’m surprised the judge went for it, and it makes me wonder if there’s a lot more going on than is being reported here.

First, why did the indictment come about nearly 2 years later? Somebody said or did or donated something to raise the interest of the prosecution.
Second, Why a bench Trial? You are taking your chances on convincing one of one, not one of twelve. Stipulating to everything looks like her attorney screwed the pooch.
Finally, this lady must either have had an angry judge or she tells a very unbelievable, guilt ridden, version of her story.
This just isn’t a simple abused wife in danger of further injury.

I wish I could remember the name of the book about black families that moved from the deep South to Milwaukee and were stuck on welfare. The author claimed that domestic violence and sexual abuse were endemic to that culture before the migration and before welfare - that the women went on welfare because they’d far rather depend on the state than on a man who beat them and cheated on them.

My Mom had bruises all the time from “running into a door jam” or “falling down the back stairs”. I saw her take a beating when I was about 7 or 8 that I haven’t forgotten in 40 yrs.

My parents were married 46 years before Dad died.

This SOB and my Dad liked to beat on weak women.

My sister and I broke that cycle. We would have done what this women did had any boyfriends or husbands tried that on us.
