This is a “good news/bad news” situation.
Doesn’t totally answer your question:
Marriage licenses in Kentucky usually have the elected clerk’s signature on them; those handed out Friday lacked any signature. The Rowan County attorney and lawyers for the gay couples said they are legal and valid nevertheless.
When the judge was asked if the licenses will be considered valid without Davis’ authorization, he said it was up to the gay couples to take that chance.
The statement on lacknof signatures came from her lawyer, was mentioned in several articles this weekend. On cell phone right now, can’t figure out how to pull them up and cut and paste. Can someone else pls help?
If they’re being issued with no signature, then she is not violating her faith, but the authorities are violating the law.
My guess is they’ll change the form.
No, the trial judge.
That’s because they live up to their book of rules for radicals.
Mortman mentioned that too.
Seems like this is no resolution to the problem.
Yes. This is a setup or Hizzonner didn’t want the public pressure and scrutiny. Any time I see a judge back off this quickly a little part of me wonders what they were doing that they did not want examined closely.
No, the trial judge.
It is conceivable to me that the appeals court could have nudged the trial judge.
I don’t think he’ll fine her - she’s shown that jailing her has no effect & in fact, it showcases her beliefs. I think he’ll up the ante and start levying crippling fines intended to destroy her personally. The sodomite contingent wanted fines to start with, not jail.
No, these are two separate issues.
In 1967, the feds were actually VALIDLY enforcing the 14A which forbids state segregation laws.
Here, the feds have NO constitutional authority whatsoever to interfere with state marriage laws or to meddle with marriage in any way.
Federal judges are not elected.
Bet the homonazis realized uh oh we went to far. Yeah we want pastors jailed too but this was making gays turn against us.
#Lovewins
Yes, she can refuse to abide by the conditions set out by the judge. Same effect.
This is from the NYT.
I’m not sure conservatives can really call this a win.
It looks like she was released because there’s no reason to hold her now that the licenses are being provided.
It will be interesting to see what Kim Davis does next.
From the Times article.
“In a two-page order issued Tuesday, the judge who sent her to jail, David L. Bunning of the Federal District Court, said he would release Ms. Davis because he was satisfied that her office was fulfilling its obligation to issue marriage licenses to all legally eligible couples.
In a two-page order issued Tuesday, the judge who sent her to jail, David L. Bunning of the Federal District Court, said he would release Ms. Davis because he was satisfied that her office was fulfilling its obligation to issue marriage licenses to all legally eligible couples.
Judge Bunning ordered that Ms. Davis shall not interfere in any way, directly or indirectly, with the efforts of her deputy clerks to issue marriage licenses to all legally eligible couples. He he said that any such action would be regarded as a violation of his released order.”
Fire the deputies who caved, but keep her son who stood by her.
OK, then hand out license forms with the space for the clerk's name either blacked out, or cut out with a razor blade. Will that make the form invalid? That is for the judge to render his opinion on.
Read about all the road blocks Washington DC used after losing District of Columbia v. Heller.
And which City of Washington DC official was jailed?
A fact that has escaped the notice of exactly ZERO divorce lawyers, anywhere. ;)
