Mediaite and Politico are running headlines for this segment claiming that Trump said the Fourteenth Amendment is unconstitutional, which is cute but unfair. What he's saying, in his own...folksy way, is that he thinks the Supremes will side with him in finding that birth right citizenship under the Constitution doesn't apply to children of illegals. What's newsy is him implying that that ruling should apply not just prospectively but retroactively ("I don't think they have American citizenship") meaning that many thousands of people - some now adults - who have lived all their lives in America would suddenly find themselves stateless.

In fact, they didn't. Their parents considered citizenship here so valuable that they stole it. And they had the use of it for quite a while, which nobody can take away from them, or even wants to. But we're a nation (almost as sovereign as Mexico . . .) and we have to protect our own citizens firstotherwise, we can't take care of others, either, because we won't exist.
If we let an infinite number of (for example) Mexicans or Guatemalans in permanently, we become the country they ran away from!

So, if a couple from anywhere outside the US buys tickets to visit the US, and the woman is pregnant and delivers in the US, the child is an American citizen? That’s ridiculous. If this is true, one could start a viable business of ‘pregnancy tourism’ for people who wanted their children to have automatic US citizenship.
I agree. The interpretation of the 14th Amendment was flawed. Those who made that interpretaton—Justice Brennen—have hell to pay. It is just like a worker on a food production line that drops a pin in the flour mixer. The entire run of product goes off the shelves and gets dumped. However, because these are human beings, I would not make the correct interpretation apply retroactively. I would mark a date on the calendar and call it the 14th Amendment Reset Day. All those born after that day do not have birthright citizenship.
The amendment is quite clear as to “subject to the laws of the United States” which the illegals and their anchor babies are not.
I want Trump to keep saying “I don’t think they have American citizenship.”

Children born to illegals are not citizens.
People who have been counted as citizens until now will probably not be denied it retroactively. But that shouldn’t prevent us from correcting a mistake moving forward.

I wouldn’t count on it. The Roberts Court makes up its own laws and definitions as it wishes.
In fact several countries have done exactly that. Chinese pregnancy tourism is well known.
They clearly do have citizenship under the current Nationality Act. Whether the birthright citizenship provisions of that statute could be repealed without violating the 14th Amendment is debatable, but to say they “don’t have” citizenship is just plain wrong.

What’s funny here, is that Jeb Bush’s wife would have been one of the “stateless”. She’s probably a citizen by now, and being married to an American she no doubt has applied and is a citizen now, but in her early years she was an illegal according to stuff I have read online.
Seems fair to me since Amnesty has been offered. "You were here when we granted amnesty, fine. You came after that door closed, you missed your opportunity."
