Good point. However, there is also a real issue as to whether the officer violated the Supreme Court’s ruling in Rodriguez vs. U.S. prior to giving the “lawful order” to put out the cigarette. From what I saw on the video, the officer returns to the car, and only has to give her the warning he had written up. Instead, he engages her in conversation, asking why she is upset. At that point, he is unreasonably, extending the stop in violation of Rodriguez. This infraction occurs prior to giving a “lawful” order. So it seems to me Rodriguez comes into play first. I think there is a pretty clear Rodriguez violation. The second issue is whether the question “ would you please put out your cigarette?” is an actual “order” it is clearly phrased as a question, to solicit a response, and is said during a conversation which potentially violates Rodriguez. I agree that he has the right to order her to put out the cigarette, if it was an order and was given during his mission. Rodriguez is pretty clear, that an officer may not delay his mission during the traffic stop. He clearly, did this when he engaged her in casaul conversation prior to issuing his warning. All, in all it was really poorly handled by both parties. There is also the issue of why the officer makes no mention of the lawful order to put out the cigarette in his report or to his supervisor. This could arguably be because it was not a lawful order. In either case, interesting issues in this case.

legal authority to order her to

know that everything he does and says

his ass. Just because the cop CAN do
something it doesn’t mean he should.
I submit that he did not mention the
cigarette issue because he started thinking
that he could be on shaky ground.
He probably should have said “Would you be less upset if I told you I’m only going to give you a warning this time?”
That being said, he might have felt she was trying to hide something. I wonder if they found any weed or other drugs in her car? It sounds like she was a drug user.
They didn’t find anything in her car. They were fishing for it though. She was charged with assaulting a police officer because she supposedly kicked him. We couldn’t see that in the video but I highly doubt that was anything. She was scared.
One thing about this that bugs me is the way the media wants to make it about race. It is as though no one else ever has a bad experience with police other than blacks. That is just crazy. I do think there is an issue with traffic cops who try to antagonize people so they can escalate the traffic violation into an arrest. Why? I do not know. Maybe they have quotas they have to meet. Maybe they are bored. But it is wrong, and it is wrong when it happens to white people just as much as when it happens to black people.
And yet he had no problem with her lit cigarette the entire time, until she back talked him.

For an idea of how cops used to be in the old days, you should read up on how the LA cops prevented the Italian Mafia from infiltrating LA. They were brutal.
The difference between cops before and cops today, is cops before went to war with the real bad guys. They didn’t pull punches, they weren’t hamstrung by PC runamok and they did what they had to do.
Today’s cops have an us against them attitude toward everybody who is not a cop. That wasn’t close to true 30 years ago let alone Sheriff Andy Taylor’s time.
Yes, a key when held in the hand can be a weapon, and I am sure that had she been holding a key or keys in her hand at the time he decided to order her from her car, he would have told her to put them down, just as he told her to extinguish her cigarette.
I was watching Hannity tonight on Fox, and during the show he said the department has now specified which policy the officer violated, and that policy was that he did not inform her of the next step or steps he was taking before issuing orders related to those steps.
I agree with this assessment. He could have told her prior to ordering her to extinguish her cigarette and prior to ordering her out of her car that I am detaining you at this time for further investigation, and I am placing you in hand cuffs at this time for your safety and mine, but you are not under arrest at this time. Now extinguish your cigarette and step out of your car.
That, I think, may have worked out better, or at least would have provided her the opportunity to understand that further investigation was about to ensue based upon her behavior.
However, does not informing her of that intent make his order unlawful? Nope. Does not informing her of that intent give her the right to defy his order and then resist him as she did? Nope. Does his not informing her of his intent relate to her death in any way at all? Nope.
He basically arrested her for behaving like a horse’s ass, which she definitely did. Now if she did actually hit him or assault him as he stated, then, yeah, she really got of hand and deserved to be arrested, and charged, and hauled off to jail.
Could he have followed procedure better and explained to her exactly what was going to happen next? Yes. Does that make him a criminal? Nope. Is he going to be charged with her death? Nope. Should he be charged with her death? Nope.
The adult woman is entirely responsible for what happened to her. She made her choices, now she’s gone, and that is all there is to it.
She wasn’t getting a ticket. She was getting a warning.
She did not know it was not a ticket. He did not make that clear. When I heard him say it I thought he meant he was warning her to cooperate “or else.” It wasn’t until later after she was arrested that I understood the ticket was not a citation but a warning.
He didn’t need to quiz her about how she felt or to be demanding about her cigarette if it was just a warning.

Dictator cop is still a dictator. The stop should have ended in a traffic citation issued, not a person hauled off to jail. Dictator cop over-reacted and escalated a non event traffic stop. Bloody idiot.

He is issuing her a ticket for a routine traffic violation. Suddenly he orders her out of the car.
Why? What was the probable cause for ordering her out of the car?

All he had to do was issue the stinking ticket. THE COP ESCALATED and had no reason to order her out of the car except to be a Dictator and throw his weight around. To command a person who was not treating him with respect just to DEMAND respect from her. You know the game.
People say she was resisting arrest. Well, what cause did the idiot cop have for arresting her in the first place? Because she wouldn’t sign the ticket. He never gave her a chance. He went straight to “put out your cigarette”. Because like any power mad dictator, he gave her a command just to control her.
Dictator cop was completely out of line and escalated the situation. All he had to do was drop the ticket in her lap and say “good day mam”.
Done. End of story. Instead dictator cop goes on a power binge. Why? Because he can and he knows a lot of people like you support his abuse of power, just out of your respect for police generally.
Maybe you need to be enlightened. After he returned to her car, there is no doubt he was still concerned about her behavior and allowing her to continue driving. As we know now, he was accurately assessing her behavior and she was compromised because of “substantial marijuana in her system”. So what did you want him to do as he was observing her erratic behavior, turn her loose and let her kill a family? He asked her to put her cigarette out, because he was preparing to ask her to get out of the car and he no doubt didn’t want his face crushed with a burning cigarette. Thai is ridiculous, the gal was not complying with his orders, she was obviously out of control and needed to be subdued.
The cop didn’t do anything other than take an obviously unstable woman whom he alleges assaulted him to jail.
You not liking his attitude matters as much to me as my not liking her attitude matters to you, and either way, none of it matters.
He didn’t kill her. She killed herself three days later, and that has nothing to do with him, so the entire subject of him and the arrest of her is moot.
She is the cause of her own death, so go argue with her about it if it bothers you.
