In Justice Scalias dissenting opinion in Obergefell v. Hodges he said, It is of no special importance to me what the law says about marriage. It is of overwhelming importance, however, who it is that rules me. Todays decree says that my Ruler, and the Ruler of 320 million Americans coast-to-coast, is a majority of nine lawyers on the Supreme Court.
Whatever ones views on marriage, our Founders made it clear that the federal government is a child of the states -- not the other way around. The Supreme Courts decision to legislate from the bench on a matter rightly left to the purview of the states is among the most blatant instances of federal overreach this country has ever seen.
Gov. Mike Huckabee, who also endorses the Convention of States Project, laid out the problem clearly in a recent op-ed:
Can the Supreme Court "decide" this? They cannot. Under our Constitution, we have three, co-equal branches of government. The courts can interpret law but cannot create it. The ruling still requires congressional funding and executive branch enforcement. The Supreme Court is not the "Supreme Branch," and it is certainly not the Supreme Being. If they can unilaterally make law, and just do whatever they want, then we have judicial tyranny.
Throughout our nation's history, the court has abused its power and delivered morally unconscionable rulings. They have rationalized the destruction of innocent human life, defined African Americans as property and justified Japanese-American internment camps. U.S. presidents, including Abraham Lincoln, Andrew Jackson, and Franklin Delano Roosevelt, ignored Supreme Court rulings, rejecting the notion that the Supreme Court can circumvent the Constitution and "make law."
I also reject the idea of "judicial supremacy" as just another flawed, failed feature of big government, inconsistent with what our founders fought a revolution to establish.
But there is hope. A constitutional recourse to judicial tyranny is gaining momentum around the country. A Convention of States, called under Article V of the Constitution, can impose constitutional limits on the federal governments power -- limits that will ensure an end to the overreach we witnessed last week.
So what can YOU do?

We can restore our country to the principles of self-governance upon which our country was founded. The Founders gave us the tool -- it's time we use it.

Art. V convention is a fantasy that will happen next Nevuary. By that time it’ll all be over. We need incremental steps to choke off the Leviathan. Things a POTUS and Congress can immediately implement.
1. End civil forfeiture.
2. End Administrative Law
3. Bring all rulemaking back to the House/Senate for an up down vote. (That will kill new regs)
4. Close down DOEnergy and DOEducation by crediting the states the proportional budget of each department. (cash starved local and state governments will jump on that)

I overheard an interesting conversation a few weeks ago. I reside in a small farming village a few miles from the Canadian border. It's a conservative little town with a lot of Dutch ancestry. There is a Dutch restaurant a few blocks away that offers large country breakfasts, and I go there often.
I overheard what sounded like two Republican committeewomen discussing the Convention of the States movement. Then I heard the name "Phyllis" mentioned a few times, and I realized that one committeewoman was educating the other against a Convention of the States. "Phyllis thinks it's too dangerous."
My social skills are good enough that I stayed out of it. On one hand, it's good that the idea is gaining traction. Unfortunately, the opposition is turning a lot of people against the idea out of fear.
We have our work cut out for us.
I don’t know if this will make or break your day but I am a Navy vet and I agree with you on this subject. I keep asking those who call for a “convention of states” just what use is it to propose amendments to a constitution that is being SYSTEMATICALLY disregarded by all levels of the federal government. So far no one has given me what I would consider a good answer.

The solution is to repeal the 17th Amendment.
Do that and there isn't a chance that anti-10th Amendment radical lawyers would be seated on a federal bench.
History will not treat well a people who gaffed off the peaceful means given to them to restore freedom.
The problem is popularly elected senators, aka three term congressmen.
Job #1 is reelection. To maximize the probability, it is wise to not anger ANY subgroup or hyphenated American, for the old media will come down hard.
Imagine our Framers’ constitution in which senators could flip off popular whims and opinion. The senate was designed to stand foursquare against the mob in the House. That purpose was defeat 102 years ago.
Article V to repeal the 17A before we can’t
For those who think the Article V process is too risky, I ask, "What other options do you see?"
To summarize from a previous post by GraceG:
1. Elect More Republicans - Failed due to RINO/Uni-party confluence.
2. Article V Convention of States to propose Amendments - Needed to try to take power from the federal government back to the states and reel in the federal leviathan.
3. State Nullification - Last ditch effort to try to take power back from the federal monster, though by this point it may be too late.
4. State Secession - Could either end up peaceably like the breakup of the Czechoslovakia in 1993 or a brutal:
5. Civil War II like the first one.... The longer we wait on #2, the more likely #3, then #4 and finally #5. .
So, do we do nothing and just wait for # 5?
Quick review: We need 34 states to pass an application, then Congress shall, by law, call a Convention of States as soon as it receives applications from 2/3 of the State Legislatures. That's 34 states. (So far both legislative chambers of 4 States, {Alabama, Alaska, Florida and Georgia}, have completely passed their resolutions and 36 state legislative chambers or bodies have filed or passed resolutions.) Amendments are proposed and voted on at the convention. Each Amendment must be ratified by ¾ of the states in order to become part of the US Constitution. Thats 38 states.

To be frank this is way too late and the majority of people in the country are not for it and do not have a fight in it. Sucks to say it but that is the way things are.

The Constitution is not being ignored in every particular. The structural parts are still in force. For instance, 0bama has not ignored his term limit (so far), we still have House elections every 2 years, etc.
That is the key - structural change that cannot be ignored.
