Commentators have missed the real significance of Justice Antonin Scalias dissent in the gay marriage case. He calls the decision a judicial Putsch, an attempt to overthrow a form of governmentours. His dissent, joined by Justice Clarence Thomas, was written to call attention to this Courts threat to American democracy.
Scalia understands the power and meaning of words and he chose the word putsch for a specific purpose.
Hence, Scalia is saying this was not only a blatant power grab and the creation of a right that does not exist, but a decision that depends on public ignorance about what is really taking place. It is our system of checks and balances and self-rule that has been undermined, he says.
In that sense, he is warning us that we need to understand the real significance of this decision, and go beyond all the commentators talking about marriage equality and equal rights for homosexuals. In effect, he is saying that the decision is really not about gay rights, but about the future of our constitutional republic, and the ability of the people to govern themselves rather than be governed by an elite panel making up laws and rights as they go.

Who would have protected your right to bear arms when your city or state passed a law making them illegal, if not SCOTUS (McDonald v. City of Chicago 2010)?

How many people in the last election could tell you any of these? Are they still being taught in school? Our most important privilege as Americans is the right to vote. We have to pass tests to drive, work for the government, get a diploma from high school or equivalent to get most jobs. Yet the most important thing we do for this country is given with only the prerequisite of being 18 years old. Scalia's right, but this has been coming a long time, ever since the first "gay-marriage" </off cant> case in 1981 in Hawaii, then called Baehr vs. Lewin. Hawaii shut that case down ("mooted" it) by passing a state law addressing the issues involved and repudiating the gay idea of "marriage". Now Hawaii can't do that.
In 2001 the leading homolitigator, Evan Wolfson of Lambda Legal, gave a long interview to a gay e-zine about their strategy, which was always to get a Fourteenth Amendment case before SCOTUS and cry "equal protection of the laws", and wait for a homer liberal to write them their decision and stuff their crap down the throats of the 50 States.
Point is, it was always their strategy to get Anthony Kennedy to give them what they wanted, from the Supreme Court bench.
Congress has long abdicated their responsibilities to the Executive. They now exist to exist and suck up K-Street Buck$.
