If that doesn't happen, I could imagine a situation where a Church is forced by some crazy judge to marry same-sex partners.
We've learned one thing this past year. The judiciary is out of control. Anything we believe in that isn't voted away will be decreed away. A law like this takes marriage out of the hands of judges.
Good plan. Let the state offer marriage ‘contracts’, and the churches offer services of ‘Holy Matrimony’, to whomever meets their religious requirements.
They will go to SCOTUS again whining that they are being excluded from ‘contracts’ by mean bigots. Man, i despise the Left

The Left sets out to destroy marriage.
The Republican response? Destroy marriage.
And the goal of Marx and Engels is fulfilled.
Marriage is destroyed.
This is the crux of the problem. If the State wasn't conferring benefits (tax breaks, health care, etc.) based on marital status, number of children, etc., there'd be less of a clamor to thus sign up for the freebies.
Seriously, how long does anyone think the Federals will allow this to stand?
This is the best solution I can see so far to the problem.
States (e.g. gov’t) should not be involved in “Licencing” marriages for the reasons the Senator stated.
How about Permanent Cohabiting Contracts.
It looks good on paper for the politicians so they can win the next election but it does not stop the corporate and big government elites from imposing their will through the judiciary on religious people whose conscience will not allow them to support gay marriage.
And get rid if the laws against bigamy. I would live to see liberal wives deal with that!
I believe Mississippi has done this just yesterday or something.

The best part about this is that it effectively gives a single state the ability to define a “marriage contract” any way it damn well pleases — even if it includes 75 different people who are all consenting adults.
Did SCOTUS say you need a permit to get married? No. Open carry for everyone.
What choice do they have?
Not sure if I understand all of this but:
If a ‘church’ unites a man and woman in marriage, then isn’t that a God thing? That is what ‘church’ is all about right?
If a ‘courthouse’ per say unites a man and a woman in marriage isn’t that a ‘contract’ thing and it becomes a ‘state’ thing? Isn’t that what States do, contracts?

Ding! they are free to move around the country and marry.
It is a civil issue, they can receive a marriage license at any municipality.
The Church is for a vow/religious vow before God. This ceremony is a commitment before God. If they, or anyone wish to be married by a religious leader, that leader must somehow understand their commitment to each other and God principles. It is the responsibility of the Shepard.
With this understanding if they agree on the religious commitment of marriage, then by all means. Welcome please sign and see you in the class....next Sunday. Oh and its pot luck so bring a covered dish ;)
