The Phi Kappa Psi fraternity at the University of Virginia said Monday that it is moving forward with a possible lawsuit against Rolling Stone magazine in the wake of the now-retracted "Rape on Campus" article.
"After 130 days of living under a cloud of suspicion as a result of reckless reporting by Rolling Stone magazine, today the Virginia Alpha Chapter of Phi Kappa Psi announced plans to pursue all available legal action against the magazine," the fraternity said in a statement.
A spokesman for the fraternity said there has not yet been a formal decision about when a lawsuit will be filed.
The announcement came one day after the magazine published a damning external review of the editorial processes that resulted in the article's publication. The article had alleged that a freshman student named Jackie had been violently gang-raped during a Phi Kappa Psi frat party in September 2012.

Apologies all around, but no firings, and certainly no apologies to the actual victims. The falsely accused frat members.
I think that if they apologized, it would be an admission of guilt, so their lawyers told them to specifically NOT apologize.
I can't figure the non-firing of Erdley, though.

The inevitability of this lawsuit is why Rolling Stone was silent on apologizing to the accused IMO. Doing so would create evidence.
I hope they name the “reporter” “editor” and who ever else they can find PERSONALLY in this suit and I hope they bankrupt them all.

Lawyers constantly tell their clients never to apologize.
Saw an interesting study that this “strategy” is usually, though doubtless not always, counter-productive.
Most people who have been actually wronged want, above anything else, to have that recognized, most especially by the person who wronged them. If they don’t get that apology, they may pursue getting that recognition in court, at immense cost to everybody but the attorneys involved.
What the study showed was that refusing to apologize greatly increased the chance of the dispute going to court, and that surprisingly it usually did not hurt their defense if the apology was rejected. In fact, it seems likely juries are more sympathetic to defendants who apologized than to those who didn’t.
So, Surprise!, it turns out the “no apology” strategy is best for attorneys, not usually their clients.

I strongly suspect an abject apology by RS would have been accepted by the fraternity, possibly with a reasonable monetary settlement.
It’s not like the evidence of an apology is going to add much to the mountain of evidence the plaintiffs have.

What about the “victim?” She made up a story that caused them immense damage.
Guess we'll never know in this case. Generally speaking, I think all lawyers believe that the less their client talks about anything the better, even at the cost of some goodwill.
As they say, anyone who defends themselves on court has a fool for a client.
Rolling Stone’s lawyers are already at work on the confidential settlement agreement and release.
I was wrong about this when it first came out. I believed the girl’s story.
I hope this fraternity receives a large settlement from RS.
When the SHTF, the media will be one of the most important and primary targets. The Left-stream media is the unabashed propaganda arm of the tyrannical government and will be used to demonize the resistance as the Nazis did to the Jews.
Once the tyrants effectively shut down the internet, the most effective means of communication for the resistance, there would be a drive to even the playing field. Cable company infrastructure and repair personal would be prime targets.
I realize most attorneys have this opinion.
I think it is reasonable to question whether they are correct that it is in their clients’ best interest. Or just their’s.
