WASHINGTON Sen. Ted Cruz said Monday that the Supreme Court probably made the wrong decision in 1982 when it ruled that public schools must provide free education to children who are in the country illegally.
Theres a strong argument to say that it was [a mistake], Cruz told a conservative radio host in Des Moines during a campaign visit to Iowa.
WHO host Jan Mickelson, an immigration hardliner, peppered Cruz with questions about Plyler v. Doe, a Texas case in which the justices ruled 5-4 that states must provide public education for students in the country illegally. Jim Plyler was the school superintendent in Tyler, and Doe referred to families living and working there when Texas cut funding for students living in the country illegally.
Mickelson argued that states should now defy the court and ignore the precedent, and prodded Cruz to embrace the idea.
The senator, a top student at Harvard Law School and former clerk to Chief Justice William Rehnquist, stepped carefully. But he agreed that the court got it wrong.
Plyler v. Doe as a legal matter is certainly binding Supreme Court precedent, Cruz said. You can have a theoretical argument about the role of the Supreme Court. But I do think there is value in the principle of stare decisis, which is a Latin term for things which are decided. There is value in legal precedent.
That said, he added, the court probably had no constitutional basis for forcing states to educate children in the country illegally.
There is a very strong argument that the 14th Amendment doesnt require that, Cruz said.

And you didn’t even touch on the vermin and diseases the children of illegal aliens bring into the country.
Cruz or Walker's greatest strength would be if "We the People" got 100% behind either of these candidates.
It's similar to what happened with reagan.
He didn't need to go through the media to talk to the people. We heard him "loud and clear."
IMO, a similar effort is needed today.

So you are right about the benefits of informing American citizens about how their scarce financial resources are not going to them, but to illegal invaders.
Yes, people vote their pocketbook. As public tax money goes to support an illegal invader infrastructure in America, less money goes to support American citizens.
Get the word out about how ordinary, hard-working American citizens are getting financially screwed by the Democratic and RINO Parties, well then, their votes will be going to a certain, All-American citizen leader, Senator Ted Cruz.

I just wish he would do something about it instead of talking about it. Everyday we see a new probably that Cruz has found but after that day no more anything. He is going to be great someday. I just know it. We just have to find a fit for him. I am thinking Supreme Court Justice or Senate Majority Leader. He is NASA guy now but hasn’t done much except one meeting with some astronauts.
Cruz is half right. The states are not responsible to educate illegal aliens. The opinion clearly stated that it could and should be revisited in the future. The ruling was not forever. The ruling sided with what was in the public’s best interest at the time. It did not provide for endless uncontrolled illegal immigration. Back in 1982 Texas was spending I think 65 million. Now it’s over 9 billion. the court held that it wasnt enough money to be concerned with yet... It can be challenged and should be. In fact the kids did not do well and their father could care less when he was interviewed 25 years later. but what school district will fight it now? its just like birth certificates, why are states giving out citizenship? they dont have to. ps the school district wanted some money for the kids. they didnt shut them out. we are screwed. we are not even allowed to make sure only our citizens are allowed to vote. simply because some folks have a different color skin. how stupid is that. hispanics in particular dont even know they are caucasion.
I can’t equate Cruz with Walker. There are still some questions about Walker, which have been highlighted by his support of ethanol in Iowa. I’m not totally convinced he isn’t a Chamber of Commerce kind of guy.
One could also point out that the election could be swayed with the 6.5 MILLION S.S. numbers still active for people over the age of 112. With these numbers not having death noted on them they are used by illegals and other sammers ...I am positive if they scoured past elections these 112 have voted....just saying.

Of course they got it wrong. But the 5 fevered black-robed savants that voted to mandate that states fund free education for illegals probably felt better about themselves after giving this goodie by judicial fiat (at the expense of the American taxpayer).
EITHER Cruz or Walkers would be a 180 degree change of direction from where we are currently with Obozo.

I saw that on Drudge, too. CRAZY! And also the millions of illegal invaders given the right to collect social security checks after they are amnestied. It’s almost like Conservatives are surrounded in America by a multi-faced enemy hostile to America itself. I only wish there were more RINOS, libs, and illegal invaders to defeat at the polls, in legislation, and with judicial decisions, because it would make our victory of Conservatism all that much more symbolically sweet when Ted Cruz is elected President of the United States of America!
The 1982 decision by the USSC in the Plyler v. Doe case was made using the same material used in the 1973 Roe v.Wade case: whole cloth. In both cases the USSC decided upon fabrication when no constitutional basis existed for the decisions. The Executive and Legislative branches of government and the states just blindly obeyed the USSC mandates instead of rejecting them as outright unconstitutional and, therefore, not enforceable. Adherence to both unconstitutional actions have caused great damage to our country.

He’s dead right. Plyler was not only wrong on the mandatory school access, but worse, it’s been used to justify insane interpretations for birthright citizenship.
It was the last despicable gift from the aging, wheezing Warren Court Liberals still there. It should be completely overturned by the Congress but preferably by amendment.
