Tennessee Joins Lawsuit Challenging Obama's Immigration Action

Tennessee's new Attorney General Herbert Slatery announced today that the state will join a lawsuit challenging President Barack Obama's recent executive action on immigration.

Texas Attorney General and Gov-elect Greg Abbott is leading the challenge, which 23 other states have now joined. Slatery said in a release Monday that the suit is not about immigration but "more about the rule of law and the limitations that prevent the executive branch from taking over a role constitutionally reserved for Congress."

"The executive directives issued by the White House and Homeland Security conflict with existing federal law," Slatery said. "They replace prosecutorial discretion, normally determined on a case by case basis, with a unilateral nonenforcement policy protecting over 4 million people. The directives also are rules that have been issued without complying with the Administrative Procedures Act."

"However frustrating and painstakingly long the federal legislative process may be, making law is the prerogative of Congress, not the executive branch. Congress can resolve all of the issues raised by this lawsuit, and the executive directives for that matter, by timely enacting legislation. But in the meantime the State cannot sit on the sidelines of this case, when unlawful directives of this magnitude grant lawful presence and other rights like work permits to such a large number. Asking a court to review this issue is the prudent choice, especially when state resources will be taxed under the directives to provide benefits like unemployment compensation and health care."

The states also signed onto the challenge are Alabama, Arizona, Arkansas, Florida, Georgia, Idaho, Indiana, Kansas, Louisiana, Maine, Michigan, Mississippi, Montana, Nebraska, North Carolina, North Dakota, Ohio, Oklahoma, South Carolina, South Dakota, Texas, Utah, West Virginia and Wisconsin.

34 is the number whereby the States have a 2/3 majority to over rule the Executive Memorandum through the Articles of Confederation of the States. It is in the Constitution somewhere. I just cannot find my pocket constitution that that I got from the Heritage Foundation.

But I think the Obama Administration believes that the Executive Memorandum is not unenforceable by anyone because he believes that the Executive Branch can write Laws. But the Saturday Night Live skit about Executive memorandum was close to reality. It stated it was an Executive Action - but it is not that it is something that Obama has used repeatedly whereby his fingerprints are no where near the trigger point - so someone else takes the fall for it. I believe Obama has overreached and he does not think anyone will thwart his actions. Where is that Sikorsky Helicopter with the huge boulder being lifted and carried when it is needed. Just needs to drop it near Obama, just maybe that would get his attention!

If Judge Hanen rules against DACA, this will be a fatal blow to Obama’s current DACA expansion to the 5 million illegal aliens that he is preparing to make amnesty for. Border Patrol agents and Sheriffs say it’s not 5 million, it’s 20 million. This number is backed up by a solicitation work order for manufacturing up to 34 Million ID Cards for these illegals.

Obama really is aiding and abetting an invasion of the USA and those in the know understand clearly why he is doing it.

Being in the center of the invasion, I've been interested in the topic for decades. I've lived in Texas and California and have watched both states deteriorate to the point of being unrecognizable. You can't go anywhere in either state except perhaps northern CA and not hear Spanish spoken. I've been saying for decades that the invasion will destroy this country, back when W was pushing amnesty and his RINOs were saying it was 'just one issue'. Yeah, right -one that affects just about every other issue.

A preliminary injunction is a temporary court order like a temporary restraining order and is left in place until removed. What it does is keep things stable and preserve the status quo until both sides prepare their longer legal filings. That can take up to a year to hear so it buys time.

Obama can ignore it but it won’t matter if he does, why? Because a Federal Court Order applies to all of government as well as government contractors.

We are not going to get a federal court order to deport millions of people. The Courts CANNOT order Obama to do anything. The Courts CAN order the people that carry out his directives and the federal contractors who receive his work orders TO STOP. Can’t order them to DO; can order them to STOP.

The goal now is to stop Amnesty by stopping the ID Cards from being manufactured. The manufacturer is General Dynamics. They are the Federal Contractor. Here’s the flow:

Stop General Dynamics by serving or notifying them
-> Stop Alien ID Card Manufacturing which in turn for illegals will:
-—> Stop SSNs
-—> Stop Work Permits
-—> Stop Federal Benefits such as EBT and Obamacare
-—> Stop Adjustments to Residency Status
-—> Stop Drivers Licenses and State IDs
-—> Stop Motor-Voter Registrations

If General Dynamics is stopped by Federal Court Order, then all the rest are stopped which means the process of Amnesty and legalization is stopped.

It doesn’t solve the problem of deportation. That has to be done by a President willing to act on it. Need to wait for that.

But it will stop EXECUTIVE Amnesty.

But then there is LEGISLATIVE Amnesty to stop and that must be done by the new Conservatives sent to Congress. I think that is going to be an even bigger fight.

All amnesty actions and so-called immigration reform must be put on the back-burner if not turned off completely. Immigration reform needs to happen only when Conservatives control Congress and the White House; NOTHING until then, not one word of legislation until then.

Immigration reform is needed because of what Ted Kennedy did in 1965. That needs to be UNDONE in a big way but only when Conservatives have the upper hand.
