According to the opinion by Judge Arthur Schwab, the presidents policy goes beyond prosecutorial discretion in that it provides a relatively rigid framework for considering applications for deferred action, thus obviating any meaningful case-by-case determination as prosecutorial discretion requires, and provides substantive rights to applicable individuals. As a consequence, Schwab concluded, the action exceeds the scope of executive authority.
This is the first judicial opinion to address Obamas decision to expand deferred action for some individuals unlawfully present in the United States.

Yep. I cannot remember who said it recently but they said prosecutorial discretion can be applied case by case but when it is applied to whole groups of people, the executive becomes a legislator.

prosecutorial discretion being cited is like the difference between a DA not pursuing a drug offense and not pursuing any drug offenses.
Because it collectively removes the intent and spirit of prosecutorial discretion of the individual, with zero regard for the plea of a human right obligation, for the individual.
I don’t have a problem with hearing each case for its merits and extenuating circumstances.
I do have a problem with carte blanche designating an overwhelming group of people special and unique status, over and above what a similar individual standard is for a legal entrant, who waits years, goes through the proper processes and spends thousands of dollars to fulfill a dream of becoming an American.
These people did not come here to become an American and only a few ever will but, only as a matter of contrived expediency.

Now that time is running out on his tenure, he understands that he must grandfather as many illegals as possible to secure future elections before his term expires, and since he will not stand for election again, the wedge issue is no longer useful to his purposes anyway.
If you're looking for the consistency in 0bama's policies, it's easy to find: Grab as much power as political expediency will allow you to have. He has been 100% consistent under that maxim.
