Republicans Hand Obama an Immigration Political Triumph
New York Magazine ^ | 11/21/2014 | Jonathan Chait

There are no serious legal questions about the administration’s plan, which will temporarily legalize the status of some 4.3 million undocumented immigrants. Even lawyers for the conservative Federalist Society concede Obama’s legal reasoning. The serious questions revolve around political norms. And conservative critics have a point that Obama is stretching norms of political behavior by enacting effective changes in the law solely on his own.

Immigration law, unlike other kinds of law, is explicitly designed by Congress to delegate authority to the president. "The Immigration and Nationality Act and other laws are chock-full of huge grants of statutory authority to the president,” notes Republican lawyer Margaret Stock.

Has congress funded any 'amnesty'? Is congress passing any new immigration laws that Obama wants? Is the House reconciling their bill with the Senate bill (Gutting the House bill)?

Nope. Didn't think so.

He made a lot of noise, and got people riled up, but he's no nearer Amnesty than he was a month ago.

This has already been attempted with the late Howard Phillips’ Taxpayers Party, renamed Constitution Party. It is so weak it could not even mount a candidacy against John Cornball in TX on November 4.

More blather. Only presidential EOs set executive policy. Any memos don't have any teeth or force of law.

I hear you. I'm only tossing that into the mix as added data to help our group analysis and planning.

Who knows -- some Freeper may spot something in these discussions that leads to an effective strategy to block Obama's illegal acts.

Perhaps some conservative congresscritter will wander into this conversation and have a 'Eureka!' moment. Could happen.

It was probably Hostage’s. I go find it

Thanks, tx. I'm bogged down with domestic chores today, and only have moments here and there to get to the computer.

I'm not seeing anything. Can you try again?

to block Obama's illegal acts.

What illegal acts? He gave a speech on Thursday. He signed a memo that said all executive branch employees must follow existing law.

I don't see any there, there, until there is an unlawful EO or other unlawful direction of the executive branch.

Here’s the solution:

http://www.breitbart.com/Big-Government/2014/11/06/McConnell-Should-Defund-the-White-House-if-Obama-Tries-Amnesty/

Turn it around on Obama and the Dems. We need to keep an eye on 2016. Impeachment, government shutdowns, etc. are distractions. Pass popular bills and keep sending them to Obama for a veto. Demand vulnerable Dems vote with you.

Shut Obama down for the next two years. Limit his travel, and WH overhead expense. Don’t fund any of his consultants. Send bill after bill, funding the government minus a few items dear to Obama. Refuse to fund departmental increases. Send last years budget back to him. Reduce NPR, PBS, NEA, etc. budgets by 1%. Americans have been belt tightening why not these orgs? Then do it again and again.

10%. At minimum. I took about a 90% haircut. They can handle losing 10% of their budget.

Howard Phillips worked under some major handicaps. He looked like a less suave version of Joe McCarthy, for one thing.

My proposal, of course, is for a new party to be founded by people who are not only virtuous and principled, but beautiful and fabulously wealthy.

Johnny, you've been making the same point for days now, but I fear you're trying to climb a teflon hill with greased boots.

Most of us understand that there's nothing legal or constitutional about what Obama's attempting here, but that's not the point. The point is, he's become a law unto himself, and is (per his established modus operandi) going to inflict a harm upon our country that won't easily be undone.

It's absolutely essential that the good people of this country figure out some way to stop him from doing this before the proverbial toothpaste is out of the tube.

You aren't going to stop him until you can point to an unlawful act.

Yep. Last one was in October. Nothing to do with immigration.

And a freeper just told me that the EO must be fought.

Obama played a lot of freepers with this.

If you click on Memorandums there are two dated November 21. Set up (criminal) Welcoming Comittees and Review immigration process to streamline.

That’s it. Maybe they’re waiting till Wednesday to post it to ruin Thanksgiving Day.

The immigration memo requires all executive branch employees to follow existing law, from what I've seen.

He's no closer to amnesty than he was a month ago.

He might be closer to stampeding some people into doing ANYTHING, like passing a law in the House that he likes.

Besides, memos are toothless, and have no force of law. EOs set executive policy.

NY Post photo caption says the photo shows him signing an executive order. If you are right, I hope they put that in the Corrections column soon.
