President Obama announced a plan Thursday night to mainstream millions of illegal immigrants with an executive order allowing them to stay instead of facing deportation, bringing howls from Republicans who complained about so-called 'anchor babies' helping their illegal parents remain in the U.S. The president calmly explained in a 15-minute speech subtitled in Spanish the parameters of what angry Republicans are calling a lawless 'amnesty.'
'Were going to offer the following deal,' he said: 'If youve been in America for more than five years; if you have children who are American citizens or legal residents; if you register, pass a criminal background check, and youre willing to pay your fair share of taxes youll be able to apply to stay in this country temporarily, without fear of deportation.' Well, there's not a lot to choose from, if we look at all the Presidents we've had "since Ronald Reagan". The choices are:
George H.W. Bush (1989-1993)
Bill Clinton (1993-2001)
George W. Bush (2001-2009)
Barack Obama (2009-present)
Given that sorry list, I would agree George W. Bush is the "best" of the lot. But being the "best President after Reagan" is like being the "best Superman movie since Superman III". The choices range from "meh" to "horrible train wreak". The sad fact is that our country has declined considerably in the last 30 years.

We must ask ourselves what was accomplished last night in the Presidents announcement that he is going to act without legislation. Let us first review the section of the US Constitution that assigns responsibility regarding Immigration and Naturalization:
Article I - The Legislative Branch
Section 8
Clause 4:
To establish an uniform Rule of Naturalization, and uniform Laws on the subject of Bankruptcies throughout the United States;
In other words, only the Legislative Branch (The House of Reps and The Senate) has any Constitutional authority to take any action regarding Immigration policy. The only charge given to the Executive Branch (POTUS) is to dutifully and faithfully enforce laws (legislation.) This actually places a restriction upon the POTUS to prevent the Executive Branch from acting without the Legislative Branch representing the people. Many will claim that the failure of the Legislative Branch to take action requires that the Executive Branch must act unilaterally! Those folks are actually calling for a consolidation of powers into a single branch of our government, in other words they are calling for ending our system of separated powers. Or to be more frank, they are actively begging to be ruled by a Tyrant!
Remember, by not taking legislative action in the Congress, the representatives of the people ARE speaking loudly and clearly. They ARE re-affirming the current laws! Not legislating IS ACTION and this action is as valid as any other action.
Now, let us review the comments that have been made by our POTUS over the last few years. We can see that he acknowledges this division of power, we can see that he admits that the division of power creates a system without a single ruler (King/Emperor) and we can see that after acknowledging our system that he has decided to act outside of that very system. In other words, he is actively deciding to act outside of his constitutional authority, therefore he is actively deciding to act in a tyrannical manner! He admits that this action would make him a Tyrant, and then decides to take the action.
Our once fine Representative Republic is lost and these next 2 years will likely be one of the most dangerous periods of time in our history. We must return to Constitutional Conservatism, or our progeny will suffer greatly.

My job in the executive branch is to carry out the laws that are passed. What I have been able to do is make a legal argument that I think is absolutely right, which is that given the resources we have, we cant do everything that Congress has asked us to do, what we can do is then carve out the DREAM Act folks.
But if we start broadening that, then essentially, I would be ignoring the law in a way that I think would be very difficult to defend legally. So thats not an option. I do get a little worried that advocates of immigration reform start losing heart and immediately thinking, well, somehow theres an out here that if Congress doesnt act, we will just have the president sign something and that will take care of it, and we wont have to worry about it. What I have said is that there is a path to get this done and that is through Congress.
