Two San Francisco residents, one of whom is disabled, are furious with what they see as an unjust parking ticket, and they have taken their complaint to federal court.
The lawsuit -- which was served Sept. 12 to The City, San Francisco Municipal Transportation Agency and one of its citation review officers, and the Police Department, its chief and the officer who issued the citation -- claims the Feb. 16 parking ticket was unlawful.
Although the fine has been greatly reduced, the plaintiffs have decided to press on with their complaint.

A college bud of mine got booted and had a similar experience. Only he was a mechanical engineer and figured out the tools he needed to take the thing apart. That's exactly what he did and set the pieces on a nearby curb.
I love your way of thinking! That sounds exactly like something my husband would do—he has zero tolerance for bullish*t bureaucracy.
In Sacramento, CA the city is right up front saying they’re going to increase parking violation revenues by $15 million per year to pay for their new basketball arena. Why anyone would park anywhere in that city knowing they’re going to be robbed escapes me!
From about 1995 to 2005 I carried a portable acetylene torch in my car.
Never used it on a boot, but a number of leftist jerks were inconvenienced.
I am very skeptical that there is such a thing as a “$25,000 Federal lawsuit”, but IANAL and I could be all the way wrong.
$25K is probably a tad over the filing fees for a typical (minor) Fed lawsuit. A $25K claim within a Federal lawsuit implies, to me, and again, I’ll happily stand corrected, gambling $15K-$20K in filing fees and probably $40K-$100K attys’ fees for a +$25K result, and yes, I understand that fees can be requested as part of a successful outcome...but to say “a successful outcome” in *any* litigation is unforeseeable is the understatement of the year.
Sounds fishy to me, that’s all. No attorney would advocate going into Federal Court for a $25K result.
Oh Lord, thank you for letting me live in remote, rural area where I can park where I want, when I want, with no problems like those described in the article and by other posters.
In your favor is the fact that the Examiner is a far left loon rag, claimed to be more accurate than the Bay Guardian,....claimed.
Saw someone with one of those hang on handicap tags hanging from the rear view mirror. Person got out and trotted into the store. I approached her on it and she got p*$$ed and said “I’m shopping for a handicapped person” and I replied “then you’re not handicapped and just took a spot a real handicapped person could have used - you’re a piece of work” - she goes away saying “deal with it” -
Cops everywhere get up go to work and drag good citizens into court everyday. How anybody can do that job i have no idea. Dirtbag thugs with guns carrying the freight for corrupt officialdom. Yet so many hold these Union thugs in high regard. No idea.
One of the comments under the article may furnish a clue: It may well be that violations of ADA (which is a Federal Law) must occur in a Federal court. So if the ticketee is claiming that the city is not honoring the exemption conveyed by the Handicapped placard, perhaps they are forced to go Federal.
I think that’s why SFMTA “reduced” the ticket to not curbing wheels on a grade...hoping to avoid having to go to Federal Court.
Since I began studying human nature in the second half of my life, I am no longer surprised.
ADA may also make it easier to have filing fees waived.
That’s how it reads to me.
Legal rights - Yes, but what Constitutional rights?
I see your point. Nevada had been mostly conservative until recent decades when we have had an influx of libs from California and elsewhere. The growing Mexican population, which votes primarily democrat has also impacted our state negatively.
What percentage of San Franciscans would you guess are conservatives? I never hear a peep out of conservative there so didn’t think there were many.
I hope that they win.
It’s very, very short-sighted of the city to discourage tourists. Boston has a similar problem.
So....not only do the cripples get access to prime parking spots in the city, but they get to park for free?
