If a guy was shooting at me from a neighbor’s back yard, he is putting my life in immediate jeopardy and I would be justified in shooting him.
If a guy is in a neighbor’s back yard and I shoot him while he is unarmed, regardless of what he did in my house - I go to jail for murder or manslaughter.

not exactly the law in my state ... if I witness my neighbor’s home being robbed and I consider the person robbing my neighbors home a threat then is permissible to stop that person under the law in my state. Don’t know the law of your state and that law may not exist in your state but in mine ... one best not be stupid and let me see them in my neighbor’s home unlawfully.

I'm pointing out the fact that if the same circumstances happened to me in my house - and I shot the perp on my front lawn while he was unarmed and not in my house or posing an immediate threat to me or mine - that I would be arrested and charged with manslaughter at minimum or murder - depending on the ambitions of the state prosecutor.

The office was responding to a robbery and the fact that the resisting party ended up dead had nothing to do with his size. If he had simply followed the office’s orders, he would be alive and well today. Period!
