It isn't battery until it is battery; but it never was battery and it wasn't a public safety issue in need of firepower. It was a power and ego trip by the retired police officer on an unarmed citizen who unintentionally annoyed him, which he took gravely disproportionate offense to -- like an adolescent gangbanger who has been "dissed", so he shoots someone.
"Might try again"? And I might win the lottery! The victim never got the chance to try again, nor to raise his little daughter or have another wedding anniversary or even see the movie. He never even stood up. I am generally favorable towards professional police officers; but please -- you are defending the indefensible.

It's telling me he finally got caught bullying and taking advantage of his so-called position, and it's telling me he immediatly realized he'd crossed the line of no return. There is no hope for him with the Lord now but sincere repentance.
As for the courts, anything could happen. I think the erosion of truth by American moral relativist leftists and legal-loophole zealots has so demoralized the American people, that is why we are so avidly arguing this case here on this thread. Usually, constitutional conservatives defend the right of society to uphold a standard of personal responsibility, accountability and decency. Wiggling out of what is at the very least a case of manslaughter by the use of excuses and rationalizations and grasping at straws is not very upright or manly of him or his defense.

He's already home. He's free to use the internet, contact friends at will, organize an intimidation campaign against the victim or witnesses -- all kinds of things he wasn't free to do in prison.
We have a leash law in this county. Dogs must be on leash at all times outside their house or fenced yard. Yet several neighbors routinely let the dogs off leash, let them pee or crap on others' well-tended lawns, disturb the peace by shouting at the dogs to come back even at 5 or 6 AM, and if a neighbor asks or tells them not to trespass any more, they do it even more. They enjoy pissing others off. County authorities will only ticket if they actually see the trespassing, so in other words, they do nothing. So you are saying, an offended neighbor would have the right to shoot the dog or the dog owner?
