The law clearly states that Congress will be notified by the Secretary of Defense before a prisoner swap in done. In addition, the law states that Congress will be assured that any prisoners being released will not return to fighting. The law has been broken by Obama and the Secretary of Defense but I am sure nothing will come of it.

Of course, nothing will happen. Obama and his gang break laws all the time. No one wants to call him out for fear of being branded a racist.

How do you know Congress wasn’t notified? I doubt, if they were, they would have done anything.

I'm not sure what exactly the law requires, but since there was never a formal declaration of war in Afghanistan I'm not sure any laws would apply. I saw this because I don't know if this dude could even be legally considered a "prisoner of war" anyway.

Oh -- and that goes for the five al-Qaeda guys at Gitmo, too. The whole purpose of having them there was that they had no legal status as either criminals subject to U.S. law or prisoners of war subject to the provisions of the Geneva Convention.

The great and amazing Obama can deal with the Taliban( Killers of Americans,babies,and women) to get a coward back... But he can’t deal with Mexico(A supposed friend of America) to get an American Soldier back.... What’s wrong here?
