A Montana couple frustrated by recent thefts allegedly set a trap for potential burglars—and upon hearing a would-be intruder after midnight on Sunday, the husband fired four shots into the darkness, he says. Now, Markus Kaarma of Missoula has been charged in the death of German exchange student Diren Dede, 17, who was hit by bullets in the head and arm, the AP reports. The couple had set up sensors and cameras around their garage, whose door they left open; Kaarma's wife, Janelle Pflager, left her purse there "so they would take it," she said, per court documents. She reportedly told police the couple had been robbed twice in three weeks.
Documents say Kaarma, 29, told a hairstylist last Wednesday that he'd been waiting three days for another burglary, shotgun at the ready, the Washington Post reports. "I’m just waiting to shoot some [obscenity] kid," he allegedly told the stylist at Great Clips, which ended up calling police over his profane language and unruly behavior, Raw Story reports. Kaarma was yesterday charged with one count of felony deliberate homicide; it's unclear why Diren was in the garage. Billings, Mont., saw a similar shooting hours before Missoula's: A homeowner shot a seminary student described as a "house guest" who was making a call in the garage. The student is expected to survive.

I don’t blame him for that, either. I do blame him for firing his shotgun into a dark garage where he had no idea who or what was actually inside it, four times. I can’t believe anyone here would defend that. Shooting blindly at a target you can’t see goes against one of the basic tenets of firearms safety (not to mention common sense), doesn’t it?
Any person who plans to defend their home against felon intruders does so precisely becuase they fear the risk to their life; any rational person wants to minimize that risk, hence the planning.
Do you think they are still not afraid as they execute the plan, no matter how many times they execute it? I have disarmed criminals with guns and knives, after practicing these moves thousands of times and I was still afraid when I did it for real. Because I appeared perfectly calm and controlled, if I had killed them, am I now a criminal?

Here’s a silly question.
Assuming there are no ordinances where he lives preventing the discharge of a firearm, technically if you don’t know someone is on your property, you can shoot your garage all you want. Right? This is hypothetical, but if I go shooting targets in my back yard and I hit my shed in the process and someone up to no good is in there, gets hit and dies, who’s fault is that? Could I be charged with entrapment?

By not buckling down and outright condemning this person ‘we’ are being accused of being sympathizers with him.
I feel that in this case, the courts are correct. This guy executed two people that broke into his house.
Far to many people are implying that because these were two ‘white’ kids they didn’t deserve to die.
They didn’t deserve to die “IN THIS CASE” because the guy sat in the ‘dark’ waiting for him. Very possibly this guy has been hit MANY times and everyone in the neighborhood thought he was an easy mark.
When I drive, I always look ahead and think of an ‘escape route’ in case someone turns in front of me, stops quickly in front of me or whatever -
I also will say LOUDLY AND OFTEN, if you try to break into my home, or hijack my vehicle - I WILL SHOOT YOU. I WILL SHOOT TO KILL YOU.
Now if you get shot breaking into my house and die, IS/WAS IT PREMEDITATED?

You should never say that you intend to kill anyone. You shouldn't even say that you shot someone. Here is what you tell the police:
"I discharged my firearm in the direction of the assailant."

Yes it DOES, if it is a qualified mantrap, which it is most certainly not.
A car the police make easy and attractive to steal, so they can watch it be stolen and then arrest the thief.

He’s lucky it wasn’t his wife, looking for something she left in the purse. There was a guy in Washington state and his gift shop had been broken into numerous times, so he took to sleeping there, shotgun at his side.
Some kid broke the window, opened the door and while grabbing some stuff heard the owner. The kid got on his bike with $40 worth of stuff in his pocket and rode off.
From 100+ feet the shop owner killed him as the owner finally got to the front door.
Found not guilty. Of course the place was locked up, and he had not bragged ahead of time about “baiting” the crook. Similar happened where a guy in Spokane left his truck unlocked and running while warming it up and a guy tried to steal it. I think the prosecutor even tried to set him up as “baiting” - but pretty easy to convince folks in Spokane that warming up the truck while you’re getting organized to leave to the next plumbing job is not an unreasonable thing to do.
And one of the primary things about having a gun on you all the time, is that you learn NOT to put yourself into situations where you might need it. Such as leaving doors open at night with no lights, etc.

No, in fact, that is not true - Montana's Castle Doctrine (which this nationalized case is designed to attack) would give the benefit of the doubt to the defender.

I use the ‘highlighted statement’ as to the ‘unwritten’ rule that you don’t pull the trigger unless you intend to finish the job.
This ‘why didn’t you shoot to hit the pistol’ or such is downright foolish. This isn’t the movies. You don’t ‘wing em’ on purpose.
As to the police....LAWYER PLEASE - after seeking medical attention for ‘stress’ etc.
When speaking to the police, I am a true advocate in ‘what you say can and will be held against you’ whether you have been ‘Mirandadized’ or not.

I used that ‘example’ based on the definition of PREMEDITATED.
Think out, or plan, beforehand.
But ‘premeditating’ in the sense I used should not ‘assist’ the prosecution.
If the guy hadn’t been ‘breaking the law’, my pre-planned action would never have been needed.
