Dems' Power Grab Will Cost Them the War over the Constitution in Court

Winning a battle that costs you a war is no victory.

The silver lining from President Obama’s and Senate Democrats’ unprecedented power grab last week is that now a conservative Republican president can appoint a Supreme Court that will restore the Constitution to its historical place in our nation’s life, revitalizing limited government and safeguarding fundamental rights.

Had conservatives invoked the nuclear option, mainstream media outlets would have given it wall-to-wall coverage under the banner, “The Death of Democracy in America.” MSNBC hosts might have openly wept on camera. Instead, those outlets are virtually silent, and what little coverage they gave made this sound like a boring, inside-the-beltway bureaucratic parlor game.

Wish it were true, but it isn't.

I remember telling my Dad at the time the "Gang of Fourteen" put together their compromise to save the judicial filibuster, "this will work until the Democrats take power. When the pretense of 'comity' is no longer convenient, bye-bye filibuster."

If the Republicans retake the Senate in 2014, they will very happily pass most of President 0dumbo's nominees, and if the Republicans retake the White House, they will not only reinstitute the filibuster to restore "comity" (given this bunch that's surely misspelled.) but in addition, I predict President Paul or Cruz or whomever, will also wind up giving us another Souter or Kennedy or O'Conner. All of them disasters, all of them appointed by Republicans, and they will avoid the appointment of ideological conservatives as too "controversial" and "unconfirmable" as they did with Bork, and very nearly Thomas when push comes to shove.

Still not going to give up the fight.

But I'll believe a conservative court when I see it.

If the GOP wins the Senate next November, couldn’t the Dems simply restore the filibuster during the Lame Duck session?

True. That fulfills Jefferson's admonition.

If Republicans regain the Senate, however, the question of the recent rules change must be dealt with as a "principles" question.

If the "nuclear option" was a violation of principle when Democrats did it, then it is a violation when Republicans do it.

Those who love liberty must, once again, come to understand and treasure the built-in checks and balances on coercive power devised so magnificently by the Founders.

There already has been enough erosion of the Founders' principles. If "the People" turn to Republicans after seeing the abuses of Reid, Obama, Pelosi and the Democrats, then Republicans should use that opportunity to explain, expound upon, and practice adherence to the principles underlying the Declaration of Independence and Constitution.

To do less would be to violate "the People's" trust.

This all assumes that two or three vacancies don’t occur in the next couple of years on the right side of the court. Heart attacks are easy.

What a quandary...

Consider that what the ‘rats/marxists/communists do is akin to a ratchet. By holding to principle, a GOP-tp Pres/house/senate would be locking that ratchet in place after it spun loose freely.

1. Get right with God, ‘cause Jesus will arrive shortly.

The filibuster is dead. It can and will only be revived when Republicans hold the Senate, in which case it will be part and parcel of the Republicans discomfort at being a majority party and they will do what they have to to give the Democrats back effective control of the Senate, the first tactic to be restoring the filibuster. From now on the filibuster will only be useful for blocking Republican nominees and eventually Republican anything else.

I'm not sure I can really follow the logic of this article.

What I do know (and have never see a competent explanation about) is that when the New Marxists are in power, a dozen years or so now, they can rip the Constitution to shreds, appoint unapologetic socialists to the highest court (and they get confirmed by the clueless RINOS!) and illegally change or ignore laws with impunity, and the GOP are like helpless school children to prevent it.

On the other hand, When the GOP gets the power, the first thoughts that gets into their tiny minds is "bipartisanship and compromise!"
Politically you can't bring a pillow to a gunfight. Being above it all, and "not lowering themselves to their enemies' level" will certainly gain lots of "Nice Fairy points" but will lose the political war, and change our country into a banana republic, perhaps permanently.

The clownGOPe for years, now, are still not aware that they are engaged in a vicious war!!*

In his dreams. After this loser's performance of the last 5 years, there better be someone else as the GOP Senate leadership, and sooner, rather than later.
If McConnell has any integrity whatsoever, he would quit tomorrow and allow someone with B***s to lead the Senate GOP.

Tonight's (Nov 27, 2013) The Kelly File on Fox News has just had a discussion about something called IPAB, which is part of the monstrously convoluted and Macchiavellian ACA (Affordable? Care Act.)

Briefly... no Congress has the power to prevent any future congress from eliminating an existing law, unless it has been passed through a Constitutional Amendment. This has always been true.
But the criminal Marxists in power today, tried a clever ploy to get around that Constitutional restraint. Are you ready for this?

They included a 'poison pill' in the law : They created this IPAB by a simple majority vote, but added a provision that it could be repealed in the future only by a supermajority!

Again, among other things, the transfer of power from Constitutionally elected representatives, to unelected and unaccountable professional bureaucrats the likes of which we have seen in the IRS, the EPA, the CIA, the State Department, the Cabinet Department of Education, etc.

We really couldn't see what was in the law, until we allowed the criminals (Pelosi, Reid, etc) to pass it in the dark of night.

1. Not if Chris Christie is president.

2. The Constitution does not say anywhere that the Supreme Court is the final arbiter of Constitutional issues. That power was arrogated to the Court in the granddaddy of all bad decisions, Marbury v. Madison, decided by John Marshall, who was appointed by Federalist, John Adams.

Yes and they will. The R’s will not have the spine to undo that and no incentive to until after the 2016 election results are in.
