SANTA CLARA CO., Calif.
San Francisco 49ers linebacker Aldon Smith has been charged with felony possession of assault weapons which were discovered after shooting at his house back in 2012, according to authorities.
The Santa Clara County District Attorneys announced Wednesday that 24-year-old Smith has been charged with three felony counts of assault weapon possession, after three rifles that are illegal to own in California were found at Smith's residence back in June of 2012.
The preamble to the assault weapons law states that each assault weapon has such a high rate of fire and capacity for firepower that its function as a legitimate sports or recreational firearm is substantially outweighed by the danger that it can be used to kill and injure human beings, District Attorney Jeff Rosen said. Californias prohibition of these powerful weapons is not about hunting or target practice. It is about interrupting the long history of death, carnage and grief assault weapons have inflicted on California communities.
The DAs release stated Smith was expected to self-surrender later in October and if convicted of the charges, he faced a maximum sentence of over four years in jail.
The 49ers issued a statement Wednesday saying, "We recognize the serious nature of this situation, as does Aldon."
Smith was on an indefinite leave from the team Wednesday while undergoing treatment for substance abuse following a DUI arrest Sept. 20
The felony charges resulted from an incident during a party at Smiths home near San Jose on June 29, 2012, according to a statement from the DAs office.

That’s a quote from the “law” ,, the law is an ass in this case ... if taken logically it is talking about the firearms rate of fire... since only a fully auto rifle has it’s own “rate of fire” it is a self defeating argument against any semi-auto ... my M1 for instance has a “rate of fire” averaging one shot every 3 months... since I just don’t go hunting that much.. then you go on to the clearly unconstitutional restriction based on intended use...

As someone else posted, and I’m sure you know, semi-auto weapons don’t have a “rate of fire” at all.
So just what is he talking about, and how would it ever hold up in a decent court if these are semi-auto rifles?
How will a court get past a defense exhibit of any other ordinary semi-auto gun and it’s “rate of fire”?

Because the operating theory is you’ll bring them home, where they’re illegal. Pretty SOP, a lot of gun shops even have signs saying they won’t sell to out of state residents because they don’t want to be involved in a sale where they know your intention is to break the law.
