Civil rights case vs. Zimmerman won't be simple

Lauren Resnick, a former federal prosecutor in New York who secured a conviction in the killing of an Orthodox Jew during the 1991 Crown Heights riots in Brooklyn, said the Justice Department could conceivably proceed under a theory that Zimmerman interfered with Martin’s right to walk down a public street based on his race. But even that is difficult since the conflict occurred in a gated community, which may not fit the legal definition of a public facility. Prosecutors would also probably need to prove that trailing Martin on the street constituted interference, she said.

‘‘One could argue it did, if it freaked him out and he couldn’t comfortably walk down the street — there’s an argument here,’’ said Resnick, who now specializes in white-collar defense and commercial litigation.

But she said federal prosecutors were likely to encounter the same hurdles as state prosecutors in establishing that Zimmerman was driven by racial animus and was the initial aggressor, as opposed to someone who acted in self-defense.

Samuel Bagenstos, a former No. 2 official in the Justice Department’s civil rights division, said: ‘‘This is an administration that hasn’t shied away from bringing hate crimes cases that are solid prosecutions based on the facts and the law, but from what I've seen this would be a very difficult case to prosecute federally because the government would have to prove beyond a reasonable doubt that George Zimmerman acted because of Trayvon Martin’s race. If you’re trying to prove racial motivation, you are usually looking for multiple statements related to why he is engaging in this act of violence. I think it’s a difficult case to prove.’’

It is a non starter, but Zimmerman’s suit against NBC has a chance of getting some justice for him. They lied and destroyed his reputation maliciously and should be made to pay for doing so.

Exactly my thoughts as well. Lets get all of those texts and pics that the prosecutor hid from the defense until the last minute violating GZ’s rights to a fair trial and violating rules of discovery, the ones the corrupt judge wouldn’t allow into evidence.

One could also argue that Eric Holder and the entie DOJ violated George Zimmerman's civil rights by monetarily supporting Martin-mobs in Sanford for the past 18 months.

And also the state artorney general, governor and Prosecutor Corey, (another Corey who should be bulldozed) for violating Zimmerman's due process and civil rights.

Even “conservatives” are buying this push that we must depend on the police for our safety and not ourselves and each other. Our neighborhood watch program was trained by police (10 years ago) to follow a stranger to the neighborhood either to his destination (locally) or out of the neighborhood. And it worked - drunks got home quicker, drug drops decreased, and all 200 families in the subdivision felt a little safer.

Now what? Call the police and hide - is that how we manage vagrants and stalkers alike? Neighborhood watch programs work - but they don’t suit the Big Brother dependence mentality.

Trayvon was a higher level victim on the racial pandering totem pole. Zimmerman violated his right do beat down a lower or equal class minority. Now, if Z had been gay....

One thing I wonder from all of this is whether Zimmerman, the democrat and Obama supporter, will see that it was conservatives who supported him from day 1, and continues to support him, despite his political affiliation, and that it is his buddies the liberals who have tried, and are continuing, to railroad him. Hopefully he sees that the liberal policies and ideologies which he supports are morally bankrupt, and leads to nothing but tyranny based on the depraved minds of the perpetually offended. But I doubt it.

Why are so many people so ignorant about the facts in this case?
He wasn’t walking down a public street. He wasn’t even on the sidewalk. He was skulking around and between the buildings, in the grass, in the rain, after dark, looking in windows.
Did NBC edit those facts out of the 911 tape too?

Yes but that won't stop Obama/Holder. This diverts attention from crimes committed by Obama/Holder.

This will be another trial where the gov's own witnesses will help the defense.

This is a perfect example of how our laws were intended to work. This case was nothing more than a political effort to appease a group of voters and NOTHING MORE. Our system defeated those efforts so lets all move on.

Now, lets get back to the odumbo scandals where there is SOooooooo much to do and so little time.

I was a Traffic Engineer in Seminole County fro 10 years in the 2000’s. I reviewed and approved all development permits for roadway and traffic issues. I understand this is in the City of Sanford and is their jurisdiction but our codes were basically the same. The law or code stated that is a subdivision is gated at the entrance the right-of-way shall remain private and under no circumstances would Seminole County take responsible for the road or maintenance of the road. So yes this is most likely a private road so the author is correct in her assumption that the road is not public.

As a producer of a very poor, but very accurate video, is still cooling his heals in jail thanks to our Great Ape’s government thugs, what makes any intelligent person think Holder and HIS people will let any law or even the Constitution block them for getting even for GZ taking out the trash?

Hispanics, wake up, this will be your life under the oppression of the protected minority. The dems only need you to stay in power other than that STFU and stay in the back of the bus.

No need for a civil rights trial. Barry has already given himself the authority to rub out any American he likes, without trial. All he needs to do is just call in a drone strike, and head for the golf course.

There’s a whole bunch of talk from the TM cheerleaders now about inadequate representation by the prosecution, and police department sabotage. Looks like this is the stick they will prod the DOJ with.
