Today, July 11th, is DAY #23 (of 5th week) State of Florida V. George Zimmerman case.
Yesterday the defense rested its case. A legal analysis via Professor Jacobson HERE.
From my perspective the entire case ended, as expected, early in the day yesterday when Judge Nelson gave George Zimmerman his personal Platinum Express DCA Acquittal Card. The ruling, and more importantly the legal determination she used on the ruling, regarding the Trayvon Martin phone evidence was an immediate Nuclear DCA option. Nelson essentially ruled against admissibility based on authentication. She could have kept it out under other legal reasoning, but no, she chose the one without the slightest chance of being upheld by a District Court of Appeals. IMHO this was intentional and aligns itself with the way she has ruled during the pre-trial discovery phase, and during the case itself. Shes a rigid ideologue, but shes not stupid this was intentional.
By ruling the phone records (texts and pics from Trayvon) cannot be authenticated to have originated by the specific personage of Trayvon Martin just gave the dismissal of the case to George Zimmerman with a bow on it.
As it was carefully explained to me, the phone is like a bucket. The data inside the phone is like marbles in a bucket. Some marbles from calls, others from pictures, others from texts, etc. The State brought the bucket into court and validated the bucket contents with their own witness from the phone company Both the State and the defense then began arguing their case around the phone call marbles in the bucket Primarily with Rachel Jeantel. But no-one challenged the bucket itself. The State authenticated the bucket and the content of the bucket during the introduction.
The defense picks up the same bucket the state hands them, and now begins to use the contents texts and pictures and then Nelson rules the bucket itself cannot be authenticated. It doesnt work that way.
If the state authenticates evidence, it cannot be divided and only authentic when the state holds it, but not the defense. Flawed logic ABSOLUTELY positioned to give such a prejudicial outcome, the appeal would result in dismissal, not retrial. Nelson gave the case away to George Zimmerman.
She could have ruled on relevance, admissibility, or other factors but she chose the one destined to fail, authentication. She gave it away.
In other news, people are catching on to the Eric Holder, Department of Justice, Civil Rights Division, Community Relations Service being the actual puppeteers behind the entire construct of the false case. To them we say welcome to the party pal.
Yeah, well, it's only his career and life on the line.
I’m both a cat and dog person. I do rescue and my house is crazy with adults and four animals, but what can I say! I’m still a conservative, though!
S&B is a type of ammo, so maybe the joke is that the State came to a gun fight armed with an unloaded gun (or a knife). (??)
No, not true. Glad you're not on the jury. You are a low-information trial observer.
If I were to make a guess I would say that Dems are NOT dog lovers..to be a dog lover you have to be caring and loving towards a living thing, the Dem party is the party of abortion and murder..I doubt they would care about pets
Makes you wonder how many close cases Baldy has brought to the house...
Liz Weihl is attaboy’n the state......good ole Fox News ( spit )
BS: Trayvon Martin deserved better than Bernie’s closing arguments.
No — they deserve each other.
I can follow you if I want to follow you.
You can not hit me or hurt me for simply following you.
I can kill you if I need to do so, to stop you from beating me.
That is the law, moron!
Question marks are not disproving case! Questions = reasonable doubt- Pick a theory or u cannot win!! Is he throwing this?!
The whole point, however, is to not be so bad that you give yourself away. :-)
a 6 woman jury scares me.
I would be curious to know that since GZ and the neighborhood watch group was concerned about a rash of burglaries before the shooting of TM, what happened to the burglary rate after the shooting?? Is it possible to assume GZ got their man?
B says Z was lying about yelling for help, then having his mouth covered by TM. Could not be covered and yelling, along with alleged lack of blood on TM hands.
It's simple. The struggle went on for about 40 seconds. At one point Z's starts yelling, then has his mouth likely covered as he claims. Then some seconds later, Z starts yelling again, after TM hands moved. TM had allegedly noticed Z had gun. goes for gun. Z starts screaming for help while's he's struggling to keep TM's hands away from gun.
No blood on TM's hands because Z wasn't bleeding enough to have blood drain out of nose? Blood only drains out of nose once Z upright for some time?
It's because of these threats that I put away my regular carry gun (a .380) in exchange for more firepower, a .45 ACP Glock. With a couple of full magazines.
I'm one of those old white males that they seem to want to kill.
Just turning in. What I’ve heard so far reminds be of a know-it-all giving an aural book report when he had not read the book. Pure BS
Bill S is pretty hard on Bernie right now
No excuse not to...
Feels like he has fallen through the looking glass
other talking head bizarre comment about the Dream speech..playing it right now
She probably is more familiar with mud.
WFTV poll: How do you think the state’s closing is going so far?
Very well (5%)
Okay (9%)
Not too well (13%)
Very poorly (71%)
No opinion (2%)
Thanks . . .
All Zimmerman had to do . . . what I would do . . . was wait for the police.
It’s astonishing that most of the things in the charging document are not illegal. “Profiling” is not only not illegal, it’s smart. Following suspicious characters is legal, and brave. Shooting a guy who’s beating your head in is legal, and smart.
There’s nothing here.
