Any excuse to confiscate.

Press charges? The warning shot might be a sane reason to question if he was reckless.

My problem with the guy is firing a warning shot - in an apartment building(!).

For the sake of the other residents, I’d say the better option would have been to give a verbal warning - and then fire into the perps BODY, if he continued to advance, thus lessening the chance of of an innocent being hurt or killed.

My 2 cents...

An AR-15 is a VERY poor weapon choice for Household/Apartment defense. A 12 Guage pump w/ 00 buck is a MUCH better choice. AND NEVER fire “warning” shots SHOOT TO KILL if you are FORCED to shoot. Remember “It is BETTER to be tried by 12 than carried by 6”!

The cops will say that if you are only firing a warning shot you are not fearful of serious injury or death. He should have never admitted firing a warning shot.

I don’t agree with the practice of giving a warning shot (especially in an apartment!).

However, the tendency of the police to confiscate is rather concerning.

What excuses will they use to confiscate from Freepers?

Warning shots are a stupid plan! In most states you must believe you are in danger before you can shoot, and if you're really in danger you will aim at the S.O.B.

If you're into warning shots better tell them you tried but missed.

If you have an intruder, do all of this that time permits:

1. Dial 911, say there’s an intruder and you think he’s going to kill you, and that you are preparing to defend yourself. Set the phone down carefully. If you have a second phone, such as a cell phone, and you have a lawyer, call his number, and set the phone down. Doesn’t matter if you get voicemail; in fact, that’s kind of the idea.

2. If applicable, place the selector level on your locked and loaded weapon on “fire” as quietly as you can manage.

3. Use your familiarity with your home and any available light to get a good sight on your intruder. If you can remotely turn on lights in his location without revealing yourself, do it.

4. The first shot he hears should be the first and last thing he hears inside your house.

5. Keep firing until you run your weapon dry or the remains have stopped twitching/wheezing. Feel free to start screaming like a little girl watching “Aliens” for the first time for the benefit of the phones. Do NOT articulate words.

5a. Maintain situational awareness for the presence of second or third intruder(s).

6. When you have secured the area, to include “stashing uninvolved weapons” (in the event of totally illegal but entirely likely search and seizure) go to the front yard and stand under a light. As police arrive, raise your hands so they are visibly up and empty before they exit their cars.

7. Say nothing to the police except your name, “I was in fear for my life”, and “I want a lawyer”, until that lawyer tells you different.

7a. Requests for beverages are acceptable.

If this had happened in Arizona, the police would have been puzzled.

“You fired a warning shot? What’s that?”

“Did your rifle misfire? Why only one shot?”

“Let me get this straight. You had a clear field of fire at someone committing a serious felony, and you decided to run them off instead of shooting them. Do you realize you would be indirectly responsible for any future crimes he might have committed, plus now the taxpayers are going to have to provide for this individual’s health and welfare for the next 20 years? Are you anti-social?”

I value my weapons a whole lot more than I value a criminal’s life. If it’s worth shooting at all at today’s ammo prices, it’s worth shooting center-mass at the predator who disturbed my routine. I’m not going to risk losing an AR-15 just to save some criminal’s life. Besides, my favorite firearms instructor taught me about warning shots, “always fire three warning shots - two in the heart, and one in the head”.

The police are saying that the Felon was running away when the gun was fired.
So now it's against the law to fire a warning shot? He should have shot the
Felon in the face to make sure the police knew the Felon was not fleeing
the scene of his crime.

The police confiscate, the prosecutor demands surrender of the firearm in exchage for dropping charges and a promise not to sue. iow blackmail.

if the citizen wins the police play stupid in order to win enough time declare forfeture and “destroy” the item. (really they just keep it for themselves)
