Blood stains are still visible on the sidewalk at the corner of Flower Street and Palm Drive, where a Bakersfield man struggled with as many as nine officers and later died this week.
David Sal Silva, 33 and the father of four young children, died early Wednesday morning after deputies say he fought with them and CHP officers who'd responded to a report of a possibly intoxicated man outside Kern Medical Center.

So, the only thing this man was ever accused of was public intoxication.

Tello said the phone of the first witness was taken after the deputies told him he was either going to give up the phone the easy way or the hard way.
"They basically told him they were either going to keep him at this house all night until they could find a judge to sign a search warrant or he could just turn over his phone," he said.
The witness gave up his phone two hours before he had to get to work and was told by deputies that he could collect his phone the next day after they had extracted the evidence they needed, Tello said.
Cops gone wild.
Tello said the witness was not allowed to go anywhere with her phone and was being quarantined inside her home.

A search warrant wasn’t presented to either of the witnesses until after Tello arrived, he said, adding that one phone was seized before the warrant was produced.

People who say they witnessed the incident as well as Silva’s family members described a scene in which deputies essentially were beating a helpless man to death. They were indignant that cellphone video had been taken away by deputies.
And we call this 1st Degree MURDER, every last person involved belongs in PRISON FOR LIFE.
Maybe it is time for a new Cell Phone App that automatically uploads ALL VIDEO TAKEN to Cloud Storage before the Jack Booted thugs STEAL YOUR PROPERTY in an effort to cover up their MURDERS.

Does this mean now that if a citizen encounters an intoxicated PUBLIC SERVANT, we can Beat them to DEATH also?? I don not understand why one of the witnesses did not start shooting theses thug criminals to protect this victim .
Living (and dying) in the ObamaNation police state can be tough.
Nuts to that...financial compensation should be taken right out of the hides of the cops themselves...no taxpayer money at all. Let them sell all their earthly posessions to pay the tab...garnish their wages until the day they die. Then maybe the others with itchy billy clubs and firearms will think twice.

I don’t trust them (not very many of them), and I can’t believe so many that say if ordered to bust in homes and confiscate guns the cops wouldn’t do it.
In addition to filing a civil suit, the owner of the phone should find a way to bring a criminal charge of grand larceny against the cop.
Man publicly intoxicated, cops drunk on power... man dead.
I always wonder why it takes so many cops to arrest one person. I can see needed a couple extra for a large or very unruly person, but nine for one person? It doesn’t make sense.
One of these days one of the honest and law abiding citizens will put down their cell phones, and treat the offending criminal element, no matter how they are dressed, like they need to be treated. Whether with a firearm, a vehicle or a posse.
Cops in this country are heavy handed pieces of excrement. I have no use for them. They do very little in the way of solving or preventing crimes. The few cops I have had opportunity to speak with have been among the dumbest people I’ve spoken to
They serve no purpose other than to collect revenue for the state and protect those working for the state from the citizenry they abuse.
There are rarely any consequences for police abuses, yet let a citizen assert their rights and see what happens to them at the hands of these POS.
I would have surrendered the phone within 5 minutes of the request. Of course I would have used that 5 minutes to upload the video to icloud, facebook and twitter along with a situation update.
