FBI Was ‘Shocked’ to See Judge ‘Waltz’ in and Give Suspect Miranda Rights

Regular viewers of Fox News are used to seeing popular host Megyn Kelly on their televisions every afternoon, but on Thursday morning Kelly made a special appearance during the morning to break some surprising information: according to her sources, the FBI was shocked to see a magistrate waltz into the hospital room of Dzhokhar Tsarnaev and read him his Miranda rights.
So why were they shocked? According to Kelly, the FBI was under the understanding that they would get much more time with Tsarnaev under the public safety exemption before he was read his rights. Adding to the shock: the sources told Kelly agents were getting crucial information after only 16 hours of questioning and were making valuable progress.
No matter.
Its really unbelievable, Kelly said.
The FBI had no idea they were sending over the judge, the prosecutor, the federal public defender; and the FBI said they were only 16 hours into what they understood would be a 48 hour period of questioning
. They said they were in the process of getting valuable information
and as soon as that magistrate judge went in there and gave him his rights with his lawyer present, he stopped talking. They said they would never have stopped interrogating him prior to the 48 hours unless they were forced to.

Kelly broke into Hannity last night to announce this "News Alert"--and her report made it clear that the FBI agents at the hospital were FURIOUS at the sudden appearance of the Federal judge.
I tried to post this as a thread last night, but got frustrated when my attempts to put it in "News/Activism" failed.
Anyway--this is a truly BRAZEN act by the Obama Admin--and I pray it gets the kind of "Fast and Furious" response it deserves!

Up to the point where they say "you are under arrest," they can ask you anything they want, and your answers can indeed be used against you in court. Miranda begins with the specific wording "You are under arrest." No arrest? No need to Mirandize. So this judge supposedly shows up in the perp's hospital room to Mirandize him? Who arrested him? Obviously not the FBI.

So... who the hell sent the judge? Who, if anyone, can send a judge? Or did someone have to file documents with a judge and get the judge's agreement as with a search warrant?
Can someone with knowledge answer that?

My beef is with the idea that the Judge GAVE the suspect rights, AND with the notion that these are “Miranda rights”. They are natural rights, guaranteed by the Constitution, and according to the Miranda decision they have to WARN you that you have those rights. It is the Miranda WARNING not Miranda rights. And those rights cannot be given or withheld by any Judge or Police Officer. They can fail to WARN you of your rights upon arrest - making anything you tell them inadmissible in court according to the Miranda decision - but they cannot give/withhold rights.

I call bull, the FBI would have never even let him through the Hospital door unless they had been ordered to from higher up and for that matter Judges don't "waltz" in of their own accord, they are directed to by somebody in the Department of Justice. Until he has been formally arraigned or he has petitioned for a writ of habeus corpus, the Judiciary has no jurisdiction.
IMHO this was orchestrated by the Justice Department at the request of Obama and Holder.
Occam's Razor.
Simply put: THEY DON'T WANT HIM TO TALK!

What do you want to bet that the federal Public Defender and that Liberal Judge are old buddies and the Public Defender asked the Judge to accompany her and read the Miranda Rights without any authorization from the Justice Department. The article says that they were accompanied by the prosecutor.
Another article mentions a bedside arraignment, so maybe all this happened at the same time.
