The White House said Monday that the surviving suspect in the Boston Marathon bombing will not be treated as an enemy combatant, in response to calls from Republican lawmakers to consider that option.
The announcement came as a sealed complaint was filed against suspect Dzhokhar Tsarnaev. Fox News has learned that the suspect made an initial appearance in front of a federal magistrate judge at the hospital where he is still being treated. No plea was entered.

No I did not have that honor. I have a physical disability which disqualifies me from service.

In the case of an American Citizen being caught on a foreign battlefield fighting for the enemy, I think that there is no question but that they can be treated as an enemy combatant.

If he’s a citizen, he has the rights of an American citizen. I just hope the “public safely” exception to the Miranda rights holds up in court.

Agree. We need to stop fudging definitions. E.g., not long after 911 suddenly every heinous crime was “terrorism”. No. Terrorism is an organized conspiracy to cause mass injury without going to war. Now we want every person with a hint of Islam and mass killing to be called a combatant - IOW a soldier. He is not a soldier of a foreign nation or even a conspiratorial organization. He is here and acted independently.
And by doing this, he can’t possibly get a “fair” trial cause it was all over the news, which means maybe Obammy will let the UN oversee the trial, and...SHOCKER, the DOMESTIC ENEMY will get off the hook.

I agree that being part of the enemy force and being captured overseas is definitely a battlefield capture of an enemy combatant.
However, IF that citizen in that foreign fighting force becomes part of an infiltration team to attack the USA, they then enter America’s porous border, and they then attack America, then I’m still thinking that the guy is CLEARLY still a member of that foreign fighting force, and that his capture would be a battlefield capture. That is, UNLESS they were out of “uniform”, they could be tried as spies.

Once a citizen takes up arms against this nation-he is a deserter/traitor in war. We had a Marine go AWOL in 1968 or so in RVN. I was shown his photo leading VC patrols by the border. I was sent in to kill him. Sadly, we could not find the traitor. This punk is no different and much more despicable. He blew up innocent unarmed civilians. I have more respect for that traitor then this punk we gave citizenship to for doing zip.

If big bra' wasn't a US citizen (and my understanding is that he was not, he was here on a green card), that makes Terrorist #2 is partnership with a foreign agent with the aim of attacking this nation. Ergo he CAN be convicted of treason.
Can't strip a natural born citizen of his US citizenship.
