Summary of Title I: This section improves background checks for firearms by strengthening the instant check system.
- Encourage states to provide all their available records to NICS by restricting federal funds to states who do not comply.
By "all their available records" just what records are they blackmailing states for with that statist bilge water? "All" is a pretty big word when only a very few records are applicable to denying someone their right to keep and bear arms.
- Allow dealers to voluntarily use the NICS database to run background checks on their prospective employees.
Does that means dealers can run NICS checks on prospective employees without their knowledge or consent? I have no idea what the word 'voluntarily' means there. Does it mean dealers will be allowed to not run NICS checks if they prefer not to?
- Clarifies that submissions of mental health records into the NICS system are not prohibited by federal privacy laws (HIPAA).
Submissions of mental health records? Since when has it been legal to deny any American their rights without due process? Isn't it required that a person be adjudicated mentally deficient by a court of law to do that? Mental health records are entirely irrelevant except to those court proceedings. This bill sounds like Stalinist purge material.
- Provides a legal process for a veteran to contest his/her placement in NICS when there is no basis for barring the right to own a firearm.
Is that an admission that the Bill of Rights doesn't cover veterans or an admission that it doesn't cover anyone anymore?
And just like that “.. shall not be infringed..” is reduced to a bumper sticker slogan..
And the worst part isn’t the background check. REad the section on transportation:
Im no lawyer, but it seems like this section means that driving across state lines with your side arm holstered would be outlawed. Beyond that, the definition of transportation includes stopping for lodging. So if I stop in Ohio overnight on my way to NC, I cant load my gun and have it in my room with me. It has to be unloaded, locked, and inaccessible. What does that have to do with shooting kids in a school. But oh, we need this bill to honor the memory of those Newtown kids. What a crock.
And it says that they need probable cause to arrest you for a violation of this law, but most state databases have a list of the CPL holders, so that would probably constitute probable cause for a search. And in any case if pulled over most states require a CPL holder to declare himself as such during a traffic stop, probably also enough to warrant a search.
Look at some of the crap in the senate gun COMPROMISE bill the republicans agreed on:
SEC. 128. INTERSTATE TRANSPORTATION OF FIREARMS OR AMMUNITION.
(a) In General.-Section 926A of title 18, United States Code, is amended to read as follows:
“926A. Interstate transportation of firearms or ammunition
“(a) Definition.-In this section, the term transport’-
“(1) includes staying in temporary lodging overnight, stopping for food, fuel, vehicle maintenance, an emergency, medical treatment, and any other activity incidental to the transport; and
“(2) does not include transportation-
“(A) with the intent to commit a crime punishable by imprisonment for a term exceeding 1 year that involves a firearm; or
“(B) with knowledge, or reasonable cause to believe, that a crime described in subparagraph (A) is to be committed in the course of, or arising from, the transportation.
“(b) Authorization.-Notwithstanding any provision of any law (including a rule or regulation) of a State or any political subdivision thereof, a person who is not prohibited by this chapter from possessing, transporting, shipping, or receiving a firearm or ammunition shall be entitled to-
“(1) transport a firearm for any lawful purpose from any place where the person may lawfully possess, carry, or transport the firearm to any other such place if, during the transportation-
“(A) the firearm is unloaded; and
“(B)(i) if the transportation is by motor vehicle-
“(I) the firearm is not directly accessible from the passenger compartment of the motor vehicle; or
“(II) if the motor vehicle is without a compartment separate from the passenger compartment, the firearm is-
“(aa) in a locked container other than the glove compartment or console; or
“(bb) secured by a secure gun storage or safety device; or
“(ii) if the transportation is by other means, the firearm is in a locked container or secured by a secure gun storage or safety device; and
“(2) transport ammunition for any lawful purpose from any place where the person may lawfully possess, carry, or transport the ammunition, to any other such place if, during the transportation-
“(A) the ammunition is not loaded into a firearm; and
“(B)(i) if the transportation is by motor vehicle-
“(I) the ammunition is not directly accessible from the passenger compartment of the motor vehicle; or
“(II) if the motor vehicle is without a compartment separate from the passenger compartment, the ammunition is in a locked container other than the glove compartment or console; or
“(ii) if the transportation is by other means, the ammunition is in a locked container.
“(c) Limitation on Arrest Authority.-A person who is transporting a firearm or ammunition may not be-
“(1) arrested for violation of any law or any rule or regulation of a State, or any political subdivision thereof, relating to the possession, transportation, or carrying of firearms or ammunition, unless there is probable cause that the transportation is not in accordance with subsection (b); or
“(2) detained for violation of any law or any rule or regulation of a State, or any political subdivision thereof, relating to the possession, transportation, or carrying of firearms or ammunition, unless there is reasonable suspicion that the transportation is not in accordance with subsection (b).”.
(b) Technical and Conforming Amendment.-The table of sections for chapter 44 of title 18, United States Code, is amended by striking the item relating to section 926A and inserting the following:
“926A. Interstate transportation of firearms or ammunition.”.
What will the NRA rate the “sorry 21” after this vote?

Tea Party groups must unite. Conservative radio talkers can help us since we see many networks are the arm of the democratic party. The next primary should be a political blood bath. We need to do whatever it takes, to get rid of these people. Anyone out there who has a good background and you respect the constitution, begin a campaign, or if you know of a solid leader, encourage them to run. We have to get rid of these current turncoats because they are the problem. The speaker is our enemy; just no other way to say it because he’s not trustworthy.
You’ll have your hands full, SC voters are so uninformed that they think Graham and McPain are “conservatives”. They will nevcer figure it out.
I would like to know what actions the NRA is taking. We hear almost nothing from them.
Did they challenge these senators? Did they warn them that the NRA will not support their campaigns and actively support their opponents?
Do they realize they can lose that surge in membership (and then some) if they do not stand up and support their membership’s interests?
What action has the NRA taken against the laws passed in NY, Conneticut, and Colorado? What support have they solicited from their supporters and politicians?
What have they done to encourage manufacturers to move out of these states?
HAVE THEY DONE ANYTHING?

I sent them $0 and a note asking why the hell are Senate Republicans voting against a filibuster of the Gun registration bill. I answered the question by saying they were a bunch of LOSERS.
