Justice Sonia Sotomayor: If Gay Marriage Is Legal, What About Polygamy?

Justice Sonia Sotomayor was questioning former U.S. Solicitor General Ted Olson, a pro-gay marriage Republican. She brought up a very interesting question during the exchange: If gay marriage is legal, what about polygamy?

Sotomayor asked, "If you say that marriage is a fundamental right, what state restrictions could ever exist?" before referencing "polygamy and incest among adults," as reported by Matt Canham of the Salt Lake Tribune. The argument is an illustration of a broader issue about the culture of American society. To agree that gay marriage is indeed protected by the "equal protection" clause in the Constitution, wouldn't the same apply for all consenting adult relationships?

Justice Sonia Sotomayor's thought-provoking question was echoed by Bishop Harry Jackson, a minister at Hope Christian Church in Beltsville, Md. He believes that "the real issue is the religious liberty issue and the issue of whether we can practice marriage as we believe it on an ongoing basis," and further stated that if same-sex marriage "is allowed to be mandated by fiat...then, right behind it, polygamy and many other forms of marriage will automatically sweep the land within just a matter of a few years." Advocates of legalizing gay marriage, as opposed to offering a compromise of "civil unions," which they argue is no different than "separate but equal" should consider this question.

Recently, President Obama's "Organizing for Action" tweeted a quote from the president, whose position on this has "evolved" in a big way from 2008, when he stated, "I believe marriage is between a man and a woman. I am not in favor of gay marriage." The tweet quoted the President as saying: "Every single American deserves to be treated equally in the eyes of the law," followed by the hashtag #MarriageEquality. If this is true, than America should do away with programs like affirmative action, which do not treat everyone "equally". Additionally, if this is true, than loving polygamous families should be allowed to get married.

Obviously, if the subject of Mormonism alone was offensive, you would have pulled out your "chastise" card and would have begun to lecture Mountainlion, Ripliancum, Boogieman, & Homeatlast.

Since you failed to do that, it can't be the subject-matter alone that's provoked you...which means you're just presumptiously prejudicial & intolerant vs. certain posters.

Most of the post manifesto marriages happened in Mexico and Canada.

More misleading info.

These occurred in Mexico only as a lame attempt to avoid legal entanglements. They amounted to a wedding & honeymoon by U.S. residents who -- after their "honeymoon" -- returned to the U.S. to live with the other "wives" (+ kids).

I agree. What is to come will not be pretty. Gay activism has always been tied to sexual amorality and sexual exhibitionism all one has to do is look at any gay “pride” parade or the bulk of “gay” events to see this is the case. Also look at what groups like GLSTN are pushing in schools and the gay proms. Its always always about overt sex, obsenity and amorality and they will keep pushing this stuff and while not all gays are like this the ones driving the politics are and those who are their allies see political power to be had over the church and individuals and that is where the harm comes in.

Same Sex Marriage boils down to even greater big government as you pointed out they will be the “enforcers”. They are already shutting down Catholic Adoption Services because of not adopting to gays, they are punishing businesses who wont cater to gay marriages, they are forcing parents to consent to their children being indoctrinated.

Some say this is inevitable. The defeat of the American Colonies was inevitable too. The ultimate dominance of the soviet union was inevitable. After Roe v Wade they said universal support for abortion would be inevitable. Inevitable is another word for “why don’t you conservatives just surrender and make our job easy”.

Isn’t it strange that the issue of traditional marriage which unites one of the most diverse coalitions of hispanics, blacks, and white conservatives is the issue that the GOP wants to go away all to capture the approval of a percentage of homosexuals. In each the blue states that held marriage related referendums the pro marriage side outperformed Mitt Romney considerably and yet these same people who want to give up on marriage would run a Mitt again in a heartbeat. The truth is if there had been parity of funding against those marriage referendums the SSM crowd would likely have lost even as Obama won those states who knows Mitt Romney might have even benefited. Instead we have a GOP that doesn’t have the balls to fight for what it claims to believe. Imagine what a billion dollars in pro traditional marriage pro conservative advertising could accomplish in this nation instead we blew it on someone who didn’t lay a hand on Obama.

Its crazy.

Polygamy has been practiced by various human civilizations for hundreds of years whereas “gay marriage” has been a recent invention barely one generation old.

Around the 1830's; GOD told a man that polygamy was now to be an eternal law.

It lasted 47 years.

There are splinter groups that want polygamy and they were called poligs or something.

TRUE Mormons (Flds) actually FOLLOW what MORMON scripture tells them to do (D&C 132).

The LARGEST group of MORMONs is run by a junta of spineless weasels that threw their GOD under the bus in favor of statehood.
