A mother and daughter who were mistakenly shot by Los Angeles police hunting for rampage suspect Christopher Dorner had no warning before bullets started whizzing through their newspaper-delivery truck, their lawyer said Friday.
No command, no instruction, no warning. They just opened fire on them, said Glen Jonas, who is representing Emma Hernandez, 71, and Margie Carranza, 47, in possible legal action against the LAPD.
They had no idea what was going on. Theyre huddling, covering up and praying and hoping theyre not going to die.
Both women survived. Hernandez, shot in the back, was in good condition Friday. Her daughter suffered a hand injury during the shooting and is now physically fine, but emotionally scarred, Jonas said.
The LAPD admits the predawn Thursday shooting was a case of mistaken identity that unfolded while police were guarding the Torrance home of someone named in a manifesto that ex-cop Dorner posted online about his twisted plans to avenge his firing.
Chief Charlie Beck said the officers saw a vehicle that matched the description of Dorners, driving through the dark streets with no headlights and a police-involved shooting ensued.
Jonas said the womens blue Toyota Tacoma looked nothing like Dorners dark-gray Nissan Titan, but that even if it had been a match, the police should not have fired on it.
They still have to give the guy an opportunity to surrender. You cant just execute him, the lawyer said. Its in these high-stress situations where you follow your training and they violated every piece of training they ever received.
The LAPD had no comment on Jonas claims.
He said he expects the city will offer his clients a substantial payout; if not, he plans to file a federal civil rights lawsuit.
Thank God they didnt die. Its a miracle they didnt, he said. If it was a movie, you wouldnt believe it.
These cops should be in prison. Absolutely no excuse for firing on a car because it looked the same.

That's just it, it DIDN'T! The suspect vehicle was a GRAY Nissan Pathfinder, this was a bright BLUE METALLIC Toyota Tundra!.........
They’ll say it was too dark to tell the difference. I guarantee that.

Never mind shooting back, what if you correctly decide that somebody is trying to kill you, so you floor it? Now they wont stop until they run your bullet-riddled truck off the road, and if it rolls over too, hey, thats what happens when you run from the police.
Was it only two cops? How many rounds are in their magazines?
Based on this it’s an obvious Cops whey will shoot Dorner on site. Judge, Jury, Executioner all in one kind of like Obama’s drone program.
I think we need legislation to ban these assault cops. Nobody needs these types of cops especially in groups of 10 or more. Assault cops kill people.
Seriously, how high can the percentage of “good ones” can their be?
A whole squad perpetrated this atrocity, and the rest of them will cover it up.

This is worse. It’s LAPD taking a woman to the ground twice. The second time is after she was handcuffed.

Of course, she was ‘resisting arrest’ and the cops felt ‘threatened’.
All I’m seeing are reasons to never again visit LA or California in general.

I dunno, I have heard many stories about cops shooting themselves in the foot......or other places...........
They could have easily been killed so yeah considering what could have been they are lucky
People keep referring here to LAPD cops doing the shooting. Weren’t they Torrance PD? Torrance is a reasonably quiet community, and the police here are determined to try to keep it that way. They have a quick response time, and patrol the place pretty thoroughly. However, they probably don’t have as much experience with armed, dangerous people as LAPD does. I am surprised that they could overreact this badly.
The Daily Breeze is the local paper. I will expect to see extensive coverage on this over the coming days.
