PHOENIX A Republican-sponsored bill barring enforcement of new federal guns laws sparked passionate debate in an Arizona Senate committee that ultimately passed the bill Wednesday.
The party-line vote moved the first of several anti-gun control bills introduced in the Legislature to the floor on the same day the U.S. Congress heard a plea from former U.S. Rep. Gabrielle Giffords to pass new gun control laws.
The bill co-sponsored by state Sen. Don Shooter, four other senators and several members of the House of Representatives would bar enforcement of new federal laws affecting semi-automatic firearms or high-capacity magazines. It also makes any federal official trying to enforce such laws guilty of a felony and allows the state Attorney General to defend anyone prosecuted for violating federal gun laws if the gun was made in Arizona, among other provisions.

Funny part...
Ableser called the bill a waste of time and asked exactly how a local law enforcement officer was going to stop a federal agent from enforcing the law.

“You have the right to remain silent, anything you say can, and WILL be used against you in a court of law, if you cannot afford an attorney, one will be apointed to you...”
Do you understand these rights as read to you??? Or, are you too stupid to understand what a predicament you are in???
I hope Texas get their bill done really quick...

Same way you arrest anybody else.
Same way you arrest any other criminal that is. The day this law is first enforced with an arrest will be a great day in American history.
Maybe I’m wrong, but local law enforcement prevails over any other police action, including federal. We need a legal type to comment.
I believe the distinction is that if the icident (crime) happens on Federal property, the Feds have the jurisdiction, obviously...
If the crime or incident happens on local county/city property, it depends upon if the incident is a Federal crime...
For instance almost ALL plane crashes are Fedral since the NTSB is the lead on those incidents, and any Law Enforcement, in support of that investigation is lead by FBI types...Local/State act in a support role...
If the crime happens during a time of crisis, if the area is declared a disaster area, either Federally or by the State, then the lines get a little more intertwined, and agencies tend to se who can wiz up higher on the wall, until someone steps in and clearly defines who is the lead agency and who is supporting those lead elements...
But hey, in this case this is going to be a mess anyway you look at it...
All I can see is the fact that when the knocks on the doors occur, I just hope a lot of us get word of those encounters in time to go to general quarters and be ready to respond accordingly and proportionally to the threat...
“Sir, please step out of your car.”
The upside of this bill as well as the others in other states is that the county sheriff who arrests feds for attemopted enforcement of unconstitutional laws is put on the short list for governor of their respective state.
Looks like this Ableser is assuming that federal agents are not subject to the same laws as everyone else in the country.
Don Shooter is my state senator. He is a treasure. I have met him a couple of times, but that is all.
I knew someone would pick up on that! It’s perfect...
I'm hearing of more and more sheriffs and/or state governments vowing not to support or enforce any gun laws, or similar executive orders, or passing laws to nullify government laws that go against the 2nd Amendment.
My question is this; can they do that? Wouldn't that amount to a war between local/state and federal government bodies?
Does anyone know?
Sheriffs have their own political constituencies unrelated to the federal government, as do state governments for that matter. Neither has to enforce federal law (see ‘sanctuary cities’ for illegal immigrants).
Executive orders don’t apply outside of the Executive Branch.
‘Nullification’ likely won’t pass legal hurdles, but the Feds can enforce on their own and withhold fed money from state and locals that don’t cooperate.
If a local sheriff decides to stand up to the feds, he should be able to deputize local citizens to assist. If he deputizes everyone who owns an assault rifle, then they should be exempt.
