Today's SCOTUS Decision Dooms Obama's Reelection

Yes, Obama and the Democrats are entitled to a bit of a victory lap today, after Chief Justice Roberts searched deeply within his political self and found a path to uphold ObamaCare.

Today's ruling will probably go down in history as the most effective GOP voter turnout operation ever. There is only one way to repeal ObamaCare and that is through the ballot box. It will happen.

Obama campaigned on a promise to never raise taxes on any families earning less than $250,000 a year. Today, the Court called the mandate for what it is...a tax. In doing so, it acknowledged that, not only did Obama break his campaign promise, but he and his leftist allies have ushered in the largest tax hike in history. They will go with that record into the voting booth in November.

From a nakedly partisan viewpoint, today's ruling is the best case scenario for the GOP. ObamaCare is still deeply unpopular and now the only way to undo it is to sweep Obama and dozens of Democrats out of office.

Roberts may have pulled off the ultimate Jedi Knight mind trick. He upheld the law by framing it as a tax, which runs counter to Obama's campaign promises. He has ensured that the only way to appeal the law is to prevail, across the board, in November. That was ultimately always the case.

Patriots around the country will now realize that there is no cavalry on the horizon. If we want to preserve our liberties, we will have to fight for it. Patriots and Independents now have a singular reason to show up at the polls in November. This focus will doom Obama's reelection campaign.

Maybe, maybe not.

None of the odious elements (and they are legion) will hit until well after the election, therefore the Great Unwashed will not have felt the impact by November.

The GOP can and should spend millions on ads detailing what is to come but the Big O and his media minions will ridicule that as 'the sky is falling' hysteria and will tout all the 'good' elements of the bill...pre-existing, kids staying on parents until mid-twenties, etc.

Do not count on those in the Great Unwashed to think beyond their next meal or nap.

A great post from you.

The individual mandate survived only as a tax.
Whether or not that tax was constitutional
was not a question that was put before the court.
And since the tax will not become effective until 2014,
it likely can not be challenged on those grounds until then.

I have two questions...

Does the fact that amount of the “tax” is income-based allow it to fall under the provisions of the 16th?

How is the federal gasoline tax classified, is it an excise tax?

I am willing to give Romney ONE WEEK to issue EO’s exempting Obamacare to all states. He said 100 times he will do it on 1st day in office. I will be generous and give him one whole week. It will not take long to find out if he is a lier.

That might be entirely true, but it is meaningless.

It is the opinion, regardless of what we think.

The question now is, what do we do for the next 130 days to end Obamacare and every other toxic change Obama has wrought.

All: Watch the price of oil today.....+4.40, this Phony-care is nothing but a hooked permanent bailout with leverage anytime they choose.

Oil up +4.40 with no move of any improvemnt in employment.

The D.C. Roberts AntiActivity Gang, runs scott-free, salaries,benefits, retirements, perks, healthcare their kind, stay above (or raises) this inflation, while everyone else is hooked or unemployed.

I see no evidence that Romney is giving all Americans waivers, none.

The Congress of the United States can now require us to do almost ANYTHING as long as they call it a "tax" when they get to court.

Okay - let's go vote in Nov.

In two years there will be another election and the same rogue's gallery of liberals coming back and proposing all kinds of new "taxes" from making us buy Chevy Volts to making us buy solar panels.

The Republic is gone.

I repeat: the Republic is gone.

We are now a neo-feudal society living at the whims of our government.

The system is GONE.

The gas tax is an excise tax.

To be a tax on income, it is necessary to identify the income being taxed. There is none.

However, it could be considered as conceptually an income tax credit. It is collected by the IRS on Form 1040. But Congress made no such claim or assertion, nor will there be any way to apply for the credit.

Congress could have made it an explicit tax credit, but didn't. Legally, it isn't. And the difference matters:

To pass a tax credit that is revenue neutral, other taxes must be raised. It is impossible to do that (by raising taxes to compensate) so that the net taxes of all those who qualify for the credit don't change. That makes it a political problem even if everyone agrees that those who don't qualify for the credit should suffer.

Fining those whose behavior you dislike does not have that problem.

The political difficulty of imposing a penalty matters. There's a reason the only Constitutionally valid way to do it without creating a bill of attainder is more difficult.
