(CNN) The Fifth Circuit's homework assignment to the Department of Justice is a disgrace -- an embarrassment to the federal judiciary. Still, it's a useful window on the contemporary merger of law and politics.
This is not judging. This is a judicial hissy fit. The Supreme Court will determine the constitutionality of the health care law, and the president will, as he must, abide by that judgment whether he agrees with it or not. In the meantime, however, the president, like all Americans, enjoys the right to express himself on what the court should do in that or any other case.
With its petulant order to the Justice Department, the Republican judges performed a peculiar, if useful, kind of service to the public -- reminding us of the partisan nature of much of the federal judiciary. The Supreme Court's decision in the health care case may offer a similar lesson.

No, Toobin, Obama is the President and THE key defender of the Constitution (remember that oath thingy he took on January 20, 2009?).
He is NOT "like all Americans". We will make him "like all Americans" on January 20, 2013. But until then, he has to be a leader with big Constitutional responsibilities. And he cannot make irresponsible public statements to express himself.

I’ve seen this Toobin guy’s mentioned before. I have no idea who he is, but from what I’ve read it seems his comprehension of reality is severely lacking. Can people with this sort of disordered thinking actually possess any marketable skills?

The comments section at the CNN site are terrific. I was going to post a reply regarding O’s definition of “judicial activism” that the Right has been screaming about but the first comment on the page nalied it for me.
And when Holder fails to comply will he be held in contempt? Arrested? Today is the deadline.

I’m torn.
As an attorney, I do think that this is a ridiculous abuse of discretion by a judge and there is no way on earth I would ever actually respond to it.
On the other hand, it’s kind of funny.
The problem is that they have acted and he ignores it if he doesn't like it. A poster above already mentioned the drilling moratorium case.
