One the best shots opponents of ObamaCare have at defeating the 2009 law isn’t its repeal through the legislative process. Instead, it is said the bill could be ruled unconstitutional by the Supreme Court for its mandate requiring individuals to purchase health insurance. And that would force Obama or the next occupant of the White House to start all over on reforming health care.
However, Washington Post columnist Charles Krauthammer doesn’t think that the judicial system acting on the issue and rendering judgment will be a bad thing for the president either way. On Friday’s “Special Report,” Krauthammer said either two of the possible outcomes would be a “win-win” for Obama.
“I think for Obama, it’s win-win,” Krauthammer said. “If it is upheld, then it will give something of a boost to public opinion because it will be seen as legitimate. It will help its legitimacy and at least slightly – marginally increase its popularity.”

Krauthammer, totally wrong once again.
Something happened to Krauthammer (or perhaps me). I used to agree with him 95% of the time. Now I almost never agree with him. He just sounds like an Obama fanboy — anything that happens seems, to him, like a good thing for the magic negro.
Well that’s it then, the states should immediatly motion to dismiss their cases because Krauthammer says overturning Obamacare will be good for his re-election. /rolleyes.
Krauthammer is way off the deep end on this. Having Obamacare ruled unConstitutional in no way removes the negative aspects of the legislation from Obama. It simply more enhances the image of Obama being a failure as a leader.
I had read here at FR someone post the complete opposite to this opinion by Krauthammer and that the ruling would be a win/win for conservatives and I tend to much more agree with that. The opinion stated basically was that if the Courts rule that it is Constitutional then it makes overturning it legislatively more a major issue and if it is ruled unConsitutional then Obama is a failure and it makes keeping it overturned just as much an issue. (Sorry I do not know where this post is to pinfg to)
Basically as it is with most issues the reality is that either way this ruling goes it is up to both sides and the campaigns to make the ruling a win for them. The conservative base is very fired up over this issue and the left had been giving up defending it. I suspect this issue will be more a win for the right either way.
Still I pray that the Courts overturn Obamacare.
I agree with K’s points...If its ruled against or for, it will be off the table for discussion..which is a win for Obama as he will have better odds for the election without the albatross...Then he will just come back and do Obama care all over again.
Obamacare is one of the most energizing issues for voters..to have this ‘off the table “ for the election is a win for Obozo.
If the SC rules in favor, he will have accomplished a lot...and it will be harder to overturn even if its a Repb adminsitration and congress.
I highly doubt that Obamacare and healthcare will be off the table regardless of how the Court decides.
If ruled against, the opposing candidate can simply make the case that Obama pushes through unconstitutional legislation and as a result, he can’t be trusted.

If the SCOTUS rules for it: yet more evidence of a tyrannical judiciary forcing the public to accept legislation it was vehemently against but Obama crammed it down our throats anyway.
If they rule against it: a major failure for Obama and the key legislation of his entire presidency.
It isn't like states haven't been changing everything and spending money on it. How many private companies have totally changed their business plans to soften the blow of the stupid law that never should have passed?
This will just prove he is a stupid jackass and unfit for office.
If I understand his reasoning, if it’s ruled unconstitutional because of the mandate, then Obama can say “I tried shaping the debate over the health care bill, but Congress forgot to include a severability clause, and now it’s gone.” That will get him off the hook?
Well, don't forget, he was leading from behind throughout the whole thing. Pelosi and her minions were doing all the heavy lifting.
He'll try to blame Congress for getting the legislation wrong by leaving out the severability clause. Wouldn't put it past him.
Seems like the only hazard for the country would be it being deemed constitutional - else, the Nation wins big time as Obama and the Dims suffer another humiliating (but well-deserved) trouncing at the voting boxes.

If the mandate is overturned, it’ll certainly become a major issue. With a major piece of healthcare law voided, the whole system is in chaos. Our candidate better be ready with a recovery plan.
If it’s not overturned, at the very least it’s back in the headlines. We can remind voters about the corrupt tactics the dems used to pass it, and the negative effect the law will have on debt, jobs, healthcare quality, etc.
I think it’s a win-win for the GOP.

He’s right. Obama will use it to run against the “right-wing” court. He’s attacked the court before, including in a state-of-the-union. He said the even leftist courts, like the Warren court, didn’t go far enough. He’d be satisfied either way and maybe more satisfied if it is struck down because it would set the stage for his actual goal of single payer.
